MWR Bicycle Checkout Program

Bicycle Checkout Agreement

Montrose West Recreation (MWR) is providing this bicycle through its Bicycle Checkout Program for recreational use. By signing this agreement, I acknowledge that I am responsible for the bicycle while it is checked out in my name.

I agree to:

• Return the bicycle, helmet, and any borrowed equipment on or before the agreed return date.
• Keep the bicycle clean and in good working condition.
• Use the bicycle only for lawful recreational purposes.
• Store the bicycle in a secure location when not in use.
• Lock the bicycle whenever it is unattended.
• Never intentionally misuse, abuse, modify, or damage the bicycle.
• Report any accident, damage, mechanical issue, loss, or theft to MWR immediately.

Required Weekly Safety Inspection

To help keep participants safe, every bicycle must receive a weekly safety inspection.

I agree to:

• Bring the bicycle to Paradox Cycle once each week for a complimentary safety inspection.
• Not ride the bicycle if it is determined to be unsafe.

Failure to complete the required weekly inspection may result in suspension of checkout privileges.

Damage, Loss, or Theft

Normal wear from responsible use is expected.

I understand that I am financially responsible for damage caused by negligence, intentional misuse, theft resulting from failure to properly secure the bicycle, or failure to return the bicycle.

If the bicycle is:

• Lost
• Stolen
• Destroyed
• Deemed a total loss beyond economical repair

I agree to pay $500 as the replacement value of the bicycle.

MWR reserves the right to determine whether damage constitutes normal wear, repairable damage, or a total loss.

Assumption of Risk

I understand that bicycling involves inherent risks, including but not limited to:

• Falls 
• Collisions
• Road hazards
• Mechanical failures
• Weather conditions
• Actions of motorists, pedestrians, or other cyclists

I voluntarily assume all risks associated with participation in this program.

Release of Liability

To the fullest extent permitted by law, I release and hold harmless Montrose West Recreation (MWR), its Board of Directors, officers, employees, volunteers, sponsors, and partners from any claims, demands, injuries, damages, losses, or liabilities arising out of my participation in the Bicycle Checkout Program, except where caused by willful misconduct or gross negligence.

Safety Requirements

I agree to:

• Wear a properly fitted helmet while riding.
• Obey all traffic laws and local regulations.
• Ride responsibly and safely.
• Not operate the bicycle while impaired by alcohol or drugs.
• Supervise minors using the bicycle, when applicable.
• Return of Equipment

Upon return, the bicycle will be inspected by Paradox Cycle.

Participants are expected to return:

• Bicycle
• Helmet
• Lock
• Keys (if applicable)
• Any additional equipment issued

Additional charges may apply for missing equipment.

Parent/Guardian Consent (Required for Participants Under 18)

I certify that I am the parent or legal guardian of the participant listed above.

I have read this agreement, understand its terms, and consent to my child's participation in the MWR Bicycle Checkout Program. I accept responsibility for ensuring that the bicycle is properly cared for and returned according to this agreement.
