Specialty Cake Order Terms & Conditions
By placing a specialty cake order with Something Sweet CupCakery LLC, you acknowledge that you have read, understand, and agree to the following Terms & Conditions.
1. NON-REFUNDABLE ORDERS
ALL SPECIALTY CAKE ORDERS ARE NON-REFUNDABLE.
Because specialty cakes are custom-made specifically for each customer, all payments and orders are considered final once the order has been confirmed.
Something Sweet CupCakery LLC does not offer refunds, exchanges, or cancellations for custom specialty cake orders that have been accepted, completed, picked up, or delivered.
Under no circumstances will Something Sweet CupCakery LLC provide a refund exceeding the original cost of the order.
2. PICKUP ONLY
ALL SPECIALTY CAKE ORDERS ARE PICKUP ONLY unless otherwise agreed upon in writing by Something Sweet CupCakery LLC.
Customers are responsible for arriving at the designated pickup time and location with an appropriate vehicle and sufficient space to safely transport the cake.
Late pickup, failure to pick up an order, or failure to provide appropriate transportation does not qualify the customer for a refund.
3. CAKE INSPECTION AT PICKUP
Customers or their designated representatives are required to inspect the cake before leaving the bakery/pickup location.
Any concerns regarding the cake's appearance, decorations, size, or general condition must be brought to the attention of Something Sweet CupCakery LLC before the cake leaves our possession.
Once the customer or designated representative accepts and leaves with the cake, the order is considered approved and accepted.
4. LIABILITY TRANSFER
Once the cake leaves the possession of Something Sweet CupCakery LLC, all responsibility and liability transfer entirely to the customer or their designated representative.
Something Sweet CupCakery LLC is not responsible for damage that occurs after pickup, including but not limited to:
Improper transportation
Cakes sliding, tipping, or shifting during transportation
Improper handling
Improper storage
Failure to follow care instructions
Exposure to heat or extreme temperatures
Outdoor conditions
Direct sunlight
Humidity or moisture
Improper venue setup
Display or placement of the cake
Damage caused by guests, children, pets, or other individuals
Refrigeration or storage issues after pickup
Once the cake has been accepted and leaves our possession, the customer assumes full responsibility for the product.
5. ENVIRONMENTAL CONDITIONS
Something Sweet CupCakery LLC cannot control weather or environmental conditions after the cake leaves our possession.
Outdoor events, direct sunlight, excessive heat, humidity, rain, or other environmental conditions may affect the cake's appearance, color, shape, texture, frosting, decorations, or overall stability.
Something Sweet CupCakery LLC is not liable for damage resulting from environmental conditions or improper venue setup.
Customers are responsible for ensuring that the cake is displayed in a safe, appropriate, temperature-controlled environment.
6. REFUNDS & EXCHANGES
All specialty cakes are custom-made products. Therefore, refunds and exchanges will not be offered for custom products that meet Something Sweet CupCakery LLC's quality standards.
Refund requests based solely on the following will not be honored:
Decorating style
Color shade or variations in color
General decoration
Design interpretation
Minor differences between inspiration/reference photos and the finished product
Subjective preferences regarding appearance
Changes resulting from weather or environmental conditions
Something Sweet CupCakery LLC strives to create each cake according to the agreed-upon order details. However, handmade and custom products may contain slight variations and will not always be an exact replica of a reference image.
7. QUALITY CONCERNS
Something Sweet CupCakery LLC will only consider a refund when the finished product does not meet the agreed-upon flavor, size, or general description of the order.
Any quality concern must be communicated to Something Sweet CupCakery LLC as soon as possible.
Once a cake has been accepted and consumed or significantly altered, Something Sweet CupCakery LLC may be unable to evaluate the concern.
8. CAKE FLAVOR & TEXTURE
Cake flavor and texture are subjective and may vary based on individual preference.
Something Sweet CupCakery LLC creates cakes from scratch using quality, all-natural ingredients. Because of this, our cakes may have characteristics that differ from commercially manufactured cakes.
Refund requests based solely on personal preference regarding flavor or texture after the cake has been accepted and picked up will be at the sole discretion of Something Sweet CupCakery LLC.
In certain circumstances, Something Sweet CupCakery LLC may consider offering a future-date credit rather than a monetary refund.
For a quality concern to be considered:
The determination of whether the flavor or texture meets our quality standards will be made solely by Something Sweet CupCakery LLC.
9. SERVING & TEMPERATURE
Our cakes should be allowed to sit at room temperature for at least one hour before serving, unless otherwise instructed.
Temperature can significantly affect the texture, flavor, frosting, fillings, and overall appearance of a cake.
Customers should follow all care and serving instructions provided by Something Sweet CupCakery LLC.
10. WEATHER & HUMIDITY
Variations in temperature and humidity may affect a cake to some degree.
Something Sweet CupCakery LLC cannot guarantee that the cake's texture, color, frosting, decorations, or shape will remain unchanged when exposed to extreme temperatures, humidity, heat, sunlight, or other environmental conditions.
Customers are responsible for maintaining appropriate conditions for the cake once it leaves our possession.
11. CUSTOM DESIGN VARIATIONS
Reference photos are used as inspiration and guidance. Handmade cakes are not guaranteed to be exact replicas of photographs provided by customers.
Slight variations in:
Color
Piping
Decorations
Placement
Shape
Texture
Design details
may occur.
These variations are considered part of the handmade/custom nature of the product and do not automatically constitute a defect or reason for a refund.
12. ACCEPTANCE OF TERMS
By submitting payment and/or placing an order with Something Sweet CupCakery LLC, the customer confirms that they have read, understand, and agree to these Terms & Conditions.
By accepting the cake at pickup, the customer or designated representative acknowledges that the cake has been inspected and accepted in its current condition and assumes responsibility for the cake once it leaves Something Sweet CupCakery LLC's possession.
