Waiver and Release. Participating in activities carries an inherent risk of injury, even if the greatest care is exercised. Accordingly, Participant(s) may injure himself/herself/themselves while attending or using Traction’s facility or observing or participating in any of Traction’s Activities and/or programs, whether at Traction or at a non-Traction facility or site. Participant(s), therefore, assume(s) any and all risk of personal injury, death, property loss, theft, damage or destruction or other damages that may arise out of or in any manner relate to attending or using Traction’s facility or observing or participating in any of Traction’s programs or Activities, whether at Traction or a non-Traction facility or site. By assuming these risks, Participant(s) waive(s) and release(s) any and all claims Participant(s) may have or may assert whether jointly or severally against Traction, including, but not limited to, Traction’s members, officers, directors, managers, employees, agents and representatives (collectively, “Traction Group”) for any such personal injuries, death, property loss, theft, damage or destruction or other damages connected to, arising out of, or in any manner relating to any of the aforesaid risks. Participant(s) release(s) Traction Group from any and all claims, damages, demands, rights of action, causes of action and liabilities, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of Participant(s) attendance at or use of Traction’s facility or Participant(s) participation in any of Traction’s Activities or programs, whether at Traction or at a non-Traction facility or site, including, without limitation, those arising from Traction’s negligence or that of Traction Group. Participant(s) also release(s) Traction Group from all liability relating to loss, theft, damage or destruction to personal property, including, without limitation, automobiles and locker contents.
Photo/Video Release. I hereby grant the TractionAP permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of the TractionAP and will not be returned. I hereby irrevocably authorize the TractionAP to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge the TractionAP from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
IN WITNESS WHEREOF, the parties have executed this Agreement, effective as of the date set forth below.
