Lessor does hereby rent to Lessee one of the following spaces, within the building located at 1000 George Washington Blvd., Akron, Ohio. This space will either be in the Blue Building or White Building, both located at Topside of Derby Downs.

• Golf Carts & Motorcycles: $300 Each
• 10 x 20 Space: $550
• Outside Storage (5 spaces): $500
• Additional: $15 per ft, over 20 ft

The term of this Rental Agreement shall be from October 15, 2026 and end April 1, 2027.  For the consideration of the above amount payable by the Lessee on or before execution of this agreement for indoor space. Customers will be called once their storage unit becomes accessible. Arrangements must be made for removal within 24 hours of notification or a fee of $10 per day after the deadline will be assessed until the unit is removed.

Payment is due at time of storage in full for the winter rental period. A non-refundable deposit of $100 per unit will reserve that space(s) for the following season.

We accept credit cards and checks. (Cash will be accepted if it is only in the exact amount of the invoice.)

4) Access:
Lessee may access its stored property by appointment ONLY during any normal business day, Monday through Friday between 9:00 a.m. and 3:00 p.m. an Lessee agrees that such access shall be only with an International Soap Box Derby employee.

5) Security:
The parties acknowledge that Lessor will provide no security arrangements for property stored on site and Lessee assumes any and all risks of loss that may be associated with the storage by him or her of property at Lessor's facility.

6) Storage Usage:
Do not use the storage unit for anything but DEAD STORAGE. Do not store any flammable, explosive or illicit materials. The unit is to be used for storage only.

7) Damage to Lessee's Property:
Lessee covenants and agrees that it will hold Lessor, its members, directors, representatives, agents, trustees, employees and insurers harmless and agrees to indemnify them from any loss occasioned by fire, theft, rain, windstorm, hail or from any other cause of any kind whatsoever, whether said cause be the direct, indirect or merely contributing factor in producing the loss to any property of Lessee that may be located or stored in the spaces designated by this Agreement and Lessee agrees that said property is stored at Lessee's own risk.

8) "As Is" Condition:
Lessee agrees to accept the space on an "as is" basis. Further, Lessor hereby disclaims, and Lessee accepts this disclaimer, of any warranty either expressed or implied of the condition, use or fitness of any of its facilities and Lessee assumes full responsibility to properly secure and store any of Lessee's property in the rental space or spaces designated herein. A fee of up to $50.00 may be charged for cleanup of any leaks, spills, etc.

9) Insurance:
Lessee agrees to keep all property fully insured against fire and any other property damage to Lessee's satisfaction and agrees and indemnifies to hold harmless Lessor, its members, agents, trustees, representatives, employees and insurers from any and all claims of damages which Lessee acknowledges shall be paid in full from any such insurance that Lessee shall maintain on the property. Lessee further agrees that it shall provide Lessor with a current certificate of insurance as to the property upon Lessor's reasonable request.

• Nothing contained herein shall constitute or otherwise be interpreted as granting to the Lessee an interest of any kind in and to the real property of the Lessor.
• Lessee agrees to indemnify, defend and save Lessor, its members, agents, employees, representatives, trustees and insurers harmless from and against any and all liability or loss resulting from claims or court action arising directly or indirectly of the activities of the Lessee, its agents, servants, guests, employees or business visitors under this Agreement, by reason of any act or omission of such person, or by reason of Lessee's occupation of the storage location.
• Lessee shall pay and discharge all reasonable costs, attorneys' fees and expenses that may be incurred by Lessor in enforcing any provision of this Agreement, and, the agreements herein contained shall be binding upon, apply and inure to their respective heirs, executors, administrators, successors and assigns.
• Lessor reserves the right to change storage spaces. Lessee agrees to occupy such spaces assigned by Lessor. Any change in storage location is at the sole discretion of Lessor upon ten (10) days prior notice to Lessee.
• There shall be no modifications of any kind made by Lessee to the storage area without the prior written consent of the Lessor.
• Lessor reserves the right to impose conditions as to the time and manner of access to at Lessor's facility.
• This Agreement shall not be modified or amended except in writing and signed by the parties hereto.
• This Agreement shall not be assigned by either party without the prior written consent of the other party. Subject to the foregoing limitation, this Agreement shall inure to the benefit of and be binding on the parties hereto and their respective successors and assigns.
• No waiver of any provision of this Agreement shall be valid unless the same is in writing and signed by the party against whom it is sought to be enforced. No waiver of any provision of this Agreement at any time will be deemed a waiver of any other provision of this Agreement at such time or will be deemed a waiver of such provision at any other time.
• This Agreement is made in Ohio and is to be construed and interpreted in accordance.
