1. Booking Confirmation & Design Direction
I will design your event using the theme, color palette, and event details that we discussed over the phone.
• Final Approval & Lock-In: Final design approvals may be communicated via text message, email, or other written messaging platforms. However, your event date is only officially secured and materials held once you have filled out the contact form, signed this contract, and submitted your full payment.
• Studio Procurement: Immediately upon receipt of your completed form, signed contract, and payment, the design direction is locked. I will then proceed to custom-source, purchase, and pre-assemble your materials in my private studio. Any design changes requested after this point are subject to additional material costs, shipping fees, and inventory availability.
2. Material Variations
The Client acknowledges that initial design proposals are conceptual representations meant to show placement and overall style. Because I hand-build and custom-assemble your balloon structures, centerpiece displays, and faux floral layouts, real-life decor colors, balloon sizes, shapes, and background textures may vary slightly due to physical manufacturing lots, phone/computer screen lighting, and raw material availability.
3. Rental Ownership & Damage Policy
All non-disposable items—including but not limited to backdrop frames, arches, table runners, display stands, themed accent props, and accessories—remain the exclusive property of Crystal Gomez and are provided strictly on a rental basis. By signing this agreement, the Client agrees to return all rental items at our arranged pickup time.
• Minor Accidents: I completely understand that minor wear-and-tear or small detached pieces can happen with custom, hand-built items during a lively celebration. You will not be penalized for minor accidental wear.
• Unrecoverable Items: The Client assumes full financial responsibility for the replacement cost of any rental items that are completely unrecoverable, permanently lost, stolen, or majorly destroyed. All rental bins must be left ready for pickup containing only my original decor materials; no trash or food should be mixed into the rental bins.
4. Delivery & Setup Options
On your event day, my crew and I will transport your pre-assembled decor inside our enclosed trailer. The Client can select one of two fulfillment options:
• Porch/Outdoor Delivery: We will drop off your prepped decor, table runners, and fully inflated balloon arches safely in a designated outdoor area or porch, alongside a simple visual floor-plan blueprint for a fast, stress-free setup. Upon drop-off, I will take a digital photograph of the decor as proof of fulfillment, at which point care and liability transfer to the Client. I am not responsible for theft, vandalism, accidental damage, or weather destruction (heat, sun, wind, rain) after drop-off.
• Full Indoor Setup Service: My crew will carry the decor inside your venue, home, or Airbnb to arrange and style everything beautifully for you. The Client must ensure the setup area is fully cleared, ready, and accessible at our scheduled arrival time. I am not liable for preexisting property conditions or accidental structural wear to the property during standard setup. Liability transfers to the Client immediately upon completion of the physical setup.
5. Standard Client Cancellation & Refund Policy
Because I reserve your event date, allocate production slots, and hand-build custom layouts, refunds for client cancellations are strictly issued based on the following timeline leading up to your scheduled event date:
• More than 14 Days Before: The Client will receive a full refund minus a 10% administrative fee. (Please note: All standard bookings must be finalized and paid in full at least 14 days prior to the event).
• Between 7 and 14 Days Before: The Client will receive a 50% refund to compensate the studio for labor and specialized materials already purchased or pre-prepared.
• Less than 7 Days Before: Cancellations made within one week of the event are 100% non-refundable, as production slots are finalized and materials are fully prepared.
6. Severe Weather & Force Majeure Emergencies (Postponement)
If a major emergency, natural disaster, or severe weather event completely outside the control of either party makes the event impossible to host on the scheduled date, I will hold your order. All funds paid will be safely retained by Crystal Gomez until a new, mutually agreed-upon event date is scheduled.
• Unrecoverable Events: In the rare instance that a major disaster occurs and the event becomes completely unrecoverable or permanently canceled, both parties agree to split the difference. I will issue a 50% refund and retain 50% to cover custom materials, production labor, and booking losses.
7. Food & Beverage Add-On Stipulations
If the Client purchases the add-on option for snacks, baked goods, and drinks, the Client assumes full responsibility for communicating any food allergies, dietary restrictions, or sensitivities of their guests to me in writing prior to delivery.
For items not prepared directly by me, I act solely as a concierge sourcing agent for third-party manufactured or commercially licensed food products. Crystal Gomez disclaims all liability for foodborne illnesses, unexpected allergic reactions, or injury resulting from the consumption of provided foods and beverages. Under Texas state law, I cannot provide or supply alcohol, but I can supply bar styling accessories, mixers, and garnishes.
