Fredericksburg Decor (FBG Decor) – Service & Custom Design Agreement
1. Collaborative Design & Mockup Process
The Client will provide their desired theme, color palette, and event details via this intake form. The Company will work closely with the Client, providing visual decor mockups and revisions to ensure the design matches the Client's vision.
Final Approval: Once a final design mockup is agreed upon, the Client must explicitly approve it via email, text, or written message.
Procurement: Once final approval is given, the design is locked. The Company will immediately proceed to purchase specialized materials and pre-prep the custom decor. Changes requested after final approval are subject to additional material costs and shipping availability.
2. Material Variations
The Client acknowledges that mockups are digital or conceptual representations. Handcrafted balloon structures and faux floral displays may vary slightly in exact texture, shape, and color matching based on physical manufacturing lots, lighting, and balloon brand availability.
3. Standard Client Cancellation & Refund Policy
Should the Client need to cancel their booking, refunds are strictly issued based on the following timeline leading up to the scheduled event date:
More than 14 Days Before: The Client will receive a full refund minus a 10% administrative and design fee.
Between 7 and 14 Days Before: The Client will receive a 50% refund to compensate the Company for design hours and any custom materials already purchased or pre-prepared.
Less than 7 Days Before: Cancellations made within one week of the event are 100% non-refundable, as materials have been fully prepared and production slots finalized.
4. Severe Weather & Force Majeure Emergencies (Postponement)
If a major emergency, disaster, or severe weather event completely outside the control of either party makes the event impossible to host on the scheduled date, the Company will hold the order. The Client's order and all funds paid will be safely retained by the Company until a new event date is scheduled.
Unrecoverable Events: In the rare instance that a major disaster or emergency occurs and the event becomes completely unrecoverable or permanently canceled, the parties agree to fairly split the difference. The Company will issue a 50% refund, and retain 50% to cover materials, production labor, and booking losses.
5. Delivery & Setup Options (Standard vs. White Glove)
Standard Porch Delivery (Default): The Client agrees to a contact-free, porch/doorway drop-off model. Physical presence is not required. Upon drop-off, the Company will take a time-stamped digital photograph of the delivered decor as definitive proof of fulfillment. Immediately upon the taking of this photo, all ownership, care, and liability transfer entirely to the Client. The Company is not responsible for theft, vandalism, accidental damage, knocking over, or weather destruction (heat, sun, wind, rain) after delivery is made.
White Glove Service (Paid Add-On Upgrade): If the Client selects the White Glove upgrade at checkout, the Company is granted permission to enter the venue or residence to carry inside and arrange the decor. The Client must ensure the setup area is fully cleared, ready, and accessible at the scheduled time. The Company is not liable for preexisting property conditions or accidental structural wear to the property during the standard setup. Liability transfers to the Client immediately upon completion of the physical styling setup.
6. Food & Beverage Add-On Stipulations
If the Client purchases the add-on option for snacks and drinks provided by the Company, the Client assumes full responsibility for communicating any food allergies, dietary restrictions, or sensitivities of their guests to the Company in writing prior to delivery.
The Company acts solely as a concierge sourcing agent for third-party manufactured or prepared food products.
The Company disclaims all liability for foodborne illnesses, unexpected allergic reactions, or injury resulting from the consumption of provided foods and beverages.
