PARENT AND PLAYER WAIVER AND RELEASE AGREEMENT

In consideration of my participation and/or the participation of my minor child or legal ward in any events, programs, or activities operated, sponsored, organized, or affiliated with New England Supreme, New England Supreme Athletics Inc., the Stratford Basketball Program, and/or the Stratford Recreation Department (collectively, the “Programs”), I acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that participation in basketball and related athletic activities involves inherent risks of injury. These risks may include, but are not limited to, falls, collisions, contact with other participants, equipment-related injuries, serious bodily injury, permanent disability, paralysis, and death.

Although established rules, appropriate equipment, supervision, and personal discipline may reduce these risks, they cannot eliminate them entirely.

To the fullest extent permitted by law, I, on behalf of myself, my spouse, and my child or legal ward, knowingly and voluntarily assume all risks associated with participation in the Programs, whether known or unknown, including risks arising from the negligence of the Releasees identified below or the actions of other participants.

I accept full responsibility for my participation and/or my child’s participation in the Programs.

PARTICIPANT RESPONSIBILITIES

I agree that I and/or my child will comply with all stated and customary rules, instructions, policies, and conditions governing participation in the Programs.

If I observe any significant concern regarding my readiness or my child’s readiness to participate, or any unsafe condition involving a Program, I will immediately discontinue participation and notify the nearest Program official.

RELEASE AND HOLD-HARMLESS AGREEMENT

On behalf of myself, my spouse, my child or legal ward, and our respective heirs, assigns, personal representatives, and next of kin, I hereby release, waive, discharge, and hold harmless New England Supreme, New England Supreme Athletics Inc., the Stratford Basketball Program, the Stratford Recreation Department, the Town of Stratford, and their respective co-founders, owners, board members, elected and appointed officials, commissioners, directors, officers, coaches, agents, employees, volunteers, participants, sponsoring organizations, sponsors, advertisers, and, when applicable, the owners and lessors of any premises used to conduct the Programs (collectively, the “Releasees”).

This release applies to any and all claims, demands, liabilities, injuries, disabilities, deaths, losses, or damages to persons or property arising from or related to my participation and/or my child’s participation in the Programs, including claims arising from the negligence of the Releasees, to the fullest extent permitted by law.

INDEMNIFICATION

On behalf of myself, my spouse, my child or legal ward, and our respective heirs, assigns, personal representatives, and next of kin, I agree to indemnify, defend, and hold harmless the Releasees from any claims, demands, liabilities, losses, costs, or expenses arising from or related to my participation and/or my child’s participation in the Programs, including claims arising from the negligence of the Releasees, to the fullest extent permitted by law.

PHOTOGRAPHY AND MEDIA AUTHORIZATION

I grant permission for photographs, video recordings, and other media featuring me and/or my child to be captured during Program-related activities and used by New England Supreme, New England Supreme Athletics Inc., the Stratford Basketball Program, the Stratford Recreation Department, and/or the Town of Stratford for lawful promotional, educational, informational, and organizational purposes.

These materials may appear on websites, social-media platforms, electronic or print publications, promotional materials, newspapers, and materials relating to basketball clinics, camps, teams, practices, leagues, tournaments, showcases, games, and other Program activities.

I understand that I will not receive compensation for the use of these materials.

PAYMENT, REFUND, AND CANCELLATION POLICY

I understand and agree that all fees must be paid in full before services are provided. Accepted payment methods include debit card, credit card, cash, Venmo, or certified check.

There will be no refunds or credits for clinics, training sessions, camps, practices, games, tournaments, showcases, or other activities missed by a participant.

If a Program is canceled because of inclement weather, a gym or facility closure, or another circumstance beyond the reasonable control of the organizing entities, reasonable efforts will be made to provide a rescheduled or make-up date. A participant’s inability to attend a scheduled make-up date does not create an entitlement to a refund.

Except as expressly stated above, all payments are final and nonrefundable.

TRAVEL-BASKETBALL FUNDRAISING REQUIREMENT

All players participating in a travel-basketball season are required to participate fully in all designated team fundraising events.

ACKNOWLEDGMENT AND AGREEMENT

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT. I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT, BY SIGNING IT, I MAY BE WAIVING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE RELEASEES.

I SIGN THIS AGREEMENT KNOWINGLY, FREELY, AND VOLUNTARILY, WITHOUT COERCION OR INDUCEMENT. I ACKNOWLEDGE THAT I HAVE BEEN ADVISED THAT I MAY CONSULT AN ATTORNEY BEFORE SIGNING THIS AGREEMENT.
