HOLD HARMLESS, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT
I acknowledge that participation in golf travel, golf outings, tournaments, transportation, lodging, excursions, recreational activities, and related travel services involves inherent risks that may result in injury, illness, disability, death, property damage, theft, financial loss, travel delays, cancellations, or other damages.

I voluntarily assume all risks, known and unknown, associated with participation in any trip, event, activity, or service arranged, coordinated, recommended, or facilitated by Elite Golf Concierge, LLC.

In consideration for being permitted to participate in any trip, event, activity, or service, I hereby fully and forever release, waive, discharge, and covenant not to sue Elite Golf Concierge, LLC, its owners, members, managers, officers, employees, agents, representatives, affiliates, contractors, successors, assigns, and any third-party vendors, suppliers, golf courses, transportation providers, lodging providers, tour operators, event organizers, and service providers (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, attorney's fees, judgments, or injuries of any kind, whether known or unknown, arising out of or relating to my participation in any trip, event, activity, or service.

This release includes, without limitation, claims arising from personal injury, illness, disease, disability, death, property damage, theft, travel interruptions, flight delays, cancellations, weather events, acts of God, acts or omissions of third parties, and the negligence of any Released Party to the fullest extent permitted by law.

I further agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, judgments, settlements, and attorney's fees arising from my actions, omissions, negligence, misconduct, violations of law, or damage caused by me to persons or property.

I acknowledge that Elite Golf Concierge, LLC acts solely as a coordinator and facilitator of travel arrangements and activities and is not responsible for the actions, omissions, negligence, services, safety standards, financial condition, performance, or conduct of any third-party provider.

I have carefully read this agreement, understand its contents, understand that I am giving up substantial legal rights, including the right to sue, and voluntarily agree to its terms.

NON-REFUNDABLE PAYMENT POLICY

All deposits, installment payments, final balances, fees, and other amounts paid to Elite Golf Concierge, LLC are non-refundable upon receipt. By submitting payment, Participant acknowledges and agrees that Elite Golf Concierge, LLC immediately incurs financial commitments and contractual obligations with hotels, resorts, golf courses, transportation providers, event venues, and other travel suppliers on Participant's behalf.

Accordingly, no refunds, credits, transfers, chargebacks, future travel credits, or reimbursement of any kind shall be provided for any cancellation, no-show, failure to travel, early departure, missed flight, schedule conflict, illness, injury, family emergency, weather event, travel disruption, government action, force majeure event, or any other reason whatsoever, whether foreseeable or unforeseeable.

Participant understands and expressly agrees that the inability or decision to participate in all or any portion of the trip does not relieve Participant of the obligation to pay for the reservation and does not entitle Participant to any refund or credit. Participant is strongly encouraged to purchase comprehensive travel insurance to protect against unforeseen circumstances that may prevent participation in the trip.

PARTICIPANT ACKNOWLEDGMENT AND AGREEMENT

By making a reservation, submitting payment, participating in the trip, or otherwise utilizing the services of Elite Golf Concierge, LLC, I acknowledge and agree that:

I have read and understand this Agreement in its entirety.
I understand and agree that all deposits, payments, and balances paid to Elite Golf Concierge, LLC are non-refundable and non-transferable under any circumstances.
I understand that travel, golf, transportation, and related activities involve inherent risks, including the risk of injury, illness, property damage, financial loss, delay, or death, and I voluntarily assume all such risks.
I release, waive, and discharge Elite Golf Concierge, LLC, its owners, officers, members, employees, agents, contractors, affiliates, successors, and assigns from any and all claims, liabilities, damages, losses, costs, and expenses arising out of or relating to my participation in the trip, except to the extent prohibited by applicable law.
I agree to defend, indemnify, and hold harmless Elite Golf Concierge, LLC, its owners, officers, members, employees, agents, contractors, affiliates, successors, and assigns from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney fees, arising from my actions, conduct, negligence, or violation of laws, rules, or regulations during the trip.
I understand that Elite Golf Concierge, LLC acts solely as a travel organizer and is not responsible for the acts, omissions, errors, delays, cancellations, injuries, losses, or service failures of any airline, hotel, resort, golf course, transportation provider, restaurant, tour operator, or other third-party supplier.
I understand that travel insurance is strongly recommended and that my decision not to purchase travel insurance does not alter the non-refundable nature of my reservation.
If I am booking on behalf of additional travelers, I represent that I have provided them with this Agreement and all applicable trip terms and conditions.
I agree that this Agreement shall be governed by the laws of the State of Arizona and that any dispute arising from this Agreement shall be brought exclusively in the state or federal courts located in Arizona.
I agree that my electronic acceptance, payment, reservation, or participation constitutes my legally binding acknowledgment and acceptance of all terms contained in this Agreement.

Registration Acknowledgment

By Submitting this registration, I acknowledge and agree to the following:

A non-refundable deposit of $2,500 per traveler is require to reserve my place on The Spain Signature Journey. The remaining trip balance is due in full no later than November 1, 2026. I understand that this journey requires a minimum of eight (8) registered participants to operate. If the minimum number of participants is not met, I will have the option to transfer my registration to a future Elite Golf Concierge journey or receive a refund of all payments made, less any non-refundable credit card processing fees charged by the payment provider.
