WAIVER AND RELEASE OF LIABILITY
In exchange for participating in the activity of dancing organized by Millennium Dance Collective, and/or use of the property, facilities, and services of Millennium Dance Collective, I agree for myself and (if applicable) for the members of my family, to the following:
ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above-described activity. I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Millennium Dance Collective, for injury, loss, or damage arising out of my or my family's use of or presence upon the facilities Millennium Dance Collective, whether caused by the fault of myself, my family, Millennium Dance Collective, or third parties. I further agree to indemnify and hold harmless Millennium Dance Collective & Co. Studios, LLC, and all other persons for any and all claims arising as a result of my engaging in or receiving instruction in Millennium Dance Collective & Co. Studios, LLC. activities or any activities incidental thereto, whenever, wherever, or however the same may occur. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury, sickness or disease to myself and (if applicable) my family members, and further release and discharge Millennium Dance Collective, for injury, loss, or damage arising out of my or my family's use of or presence upon the facilities of Millennium Dance Collective, whether caused by the fault of myself, my family, Millennium Dance Collective, or third parties.
IDENTIFICATION. I agree to indemnify and defend Millennium Dance Collective against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Millennium Dance Collective.
INSURANCE POLICY: Millennium Dance Collective does not carry medical insurance for our students. Our policy requires that all students be covered by their own family insurance policies, and if an injury occurs, students will only be covered under their own policy. The student's own insurance will be the only source of reimbursement.
FEES. I agree to pay for all damages to the facilities of Millennium Dance Collective caused by any neglect, reckless, or willful actions by me or my family.
DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this agreement through friendly negotiations among themselves. If the matter is not resolved by negotiation, the parties will resolve the dispute using the following Alternative Dispute Resolution (ADR) procedure. Any legal or equitable claim that may arise from participation in the above shall be resolved under North Carolina Law. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rule of mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it in any court having proper jurisdiction.
RIGHT TO DECLINE: Millennium Dance Collective holds the right to decline or suspend any student from any class, program, or performance event due to the following, but not limited to, inappropriate behavior, disrespect, or recurring negative behavior from the student or parent, multiple tardies, multiple absences from class, recurring bullying in class, or gossiping in class. No refunds will be given for classes that the student is suspended from.
