RELEASE OF LIABILITY
I acknowledge that participating in the Mid-Ohio Fall Crawl Poker Run involves inherent risks that may result in serious injury, permanent disability, death, and/or property damage. These risks include, but are not limited to:
Motorcycle operation
Roadway hazards
Traffic conditions
Weather conditions
Mechanical failure
Negligence of other motorists
Actions of other participants
Animal crossings
Road debris
Falls or collisions
Participation at event stops
Consumption of food or beverages
I voluntarily choose to participate despite these known and unknown risks.
I certify that:
I am at least eighteen (18) years of age, or my parent/legal guardian has signed below.
I possess the physical ability to safely participate.
If operating a motorcycle, I possess a valid motorcycle endorsement as required by Ohio law.
The motorcycle I operate is properly licensed, insured, and maintained.
I will obey all applicable federal, state, and local traffic laws.
I understand this is not a race and that I am solely responsible for operating my motorcycle safely.
ALCOHOL AND DRUG POLICY
I understand that operating a motorcycle while impaired by alcohol or drugs is illegal and dangerous.
I certify that:
I will not operate a motorcycle while impaired.
Event organizers reserve the right to refuse participation to anyone believed to be impaired.
Any alcoholic beverages consumed during or after the event are my sole responsibility.
ASSUMPTION OF RISK
I knowingly and voluntarily assume all risks associated with participation in this event, whether known or unknown, foreseeable or unforeseeable.
I accept full responsibility for any injury, death, loss, or damage that may occur to myself, my passengers, my motorcycle, or my personal property.
RELEASE
To the fullest extent permitted under Ohio law, I hereby release, waive, discharge, and covenant not to sue:
Mid-Ohio BikeFest, Inc.
Its officers
Directors
Volunteers
Employees
Sponsors
Vendors
Property owners
Event hosts
Poker run stop locations
Municipalities
Law enforcement agencies providing assistance
Any affiliated organizations
Their respective successors, heirs, agents, representatives, insurers, and assigns
from any and all liability, claims, demands, damages, causes of action, costs, expenses, attorney fees, or losses arising from my participation in the Mid-Ohio Fall Crawl Poker Run, including claims arising from ordinary negligence.
This release does not apply to claims resulting from willful misconduct or gross negligence where such waiver is prohibited under applicable Ohio law.
MEDICAL AUTHORIZATION
If emergency medical treatment becomes necessary, I authorize emergency personnel to provide medical care deemed appropriate.
I understand I am solely responsible for all medical expenses incurred.
PHOTO AND MEDIA RELEASE
I grant Mid-Ohio BikeFest, Inc. permission to photograph, record, or otherwise capture my likeness during the event.
I authorize the use of such photographs or recordings for promotional, advertising, marketing, social media, website, or other lawful purposes without compensation.
INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, liabilities, costs, or expenses arising from my participation or from any damage or injury caused by my actions.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Ohio.
Any legal action arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Ohio.
ACKNOWLEDGMENT
I certify that:
I have carefully read this entire document.
I understand its contents.
I understand I am giving up substantial legal rights.
I sign this agreement voluntarily and without coercion.
