Pickleball Tournament Registration and Liability Waiver

This Registration, Waiver, and Release Agreement (the "Agreement") is entered into between the participating player ("Participant") and the Forest Hills Park Association ("FHPA") and its fundraising board, Friends of Forest Hills Park Association (collectively, the "Host Entities"). This Agreement applies to the Participant, as well as any family members or guests accompanying the Participant to the event.

By registering for the tournament and signing below, you agree to all of the following terms:

I. Tournament Privileges, Event Changes & Withdrawals

In exchange for the timely payment of registration fees, Participant is granted entry into the FHPA Pickleball Tournament hosted by the Friends of Forest Hills Park Association. Participant agrees to follow all tournament rules, scheduling, and standard codes of conduct. In the event of a rainout, extreme weather, or unforeseen facility closures, the tournament will not be outright canceled. The makeup rain-date will be Sunday, August 30, 2026. Registered players will automatically have their entries transferred to the new date or receive a credit toward a future tournament. If the tournament is canceled entirely by the organizers without a rescheduled date, all registered participants will receive a full refund. 

The Host Entities reserve the right, at any time and in their sole discretion, to immediately revoke a Participant’s tournament privileges and remove them (or their guests) from the park premises without a refund if they become unruly, fail to obey instructions from tournament staff, or fail to comply with event rules.

 II. Refund Policy

Participant accepts and fully understands that all tournament registration fees are subject to the following strict guidelines. Full refunds (minus the standard Stripe credit card processing fees and a $5 platform technology fee) are available for any cancellations submitted up to August 23, 2026. Outside of the standard refund window or organizer cancellation, tournament fees are strictly nonrefundable. Under no circumstance will the Host Entities be required to refund any portion of the fees due to player-side cancellations after the deadline.No refunds will be issued if a registered player's partner drops out late or if a team is ultimately unable to field a complete side by game day. It is the player's responsibility to find a replacement partner to secure their spot.

III. Waiver and Release of Liability

I understand and acknowledge that competitive sports, pickleball, and related physical activities held at the FHPA facilities involve inherent risks of physical injury, which can cause serious and even fatal injuries. I agree that I will not sue and will release FHPA, the Friends of Forest Hills Park Association, and their respective officers, directors, employees, volunteers, insurers, and staff (collectively, the "Indemnitees"), from any and all liabilities, claims, or demands resulting from my, my family’s, and/or my guests’ participation in or attendance at this tournament.

IV. Assumption of Risk and Indemnification

As a condition of my tournament registration, I agree to defend, indemnify, and hold harmless the Indemnitees from any loss, liability, damage, cause of action, or cost of any kind (including court costs and attorney's fees) that may incur as a result of any injury to myself, my family members, or my guests arising directly or indirectly out of my participation in this event. This applies even if it is contended that such injury was caused by the negligence or improper conduct on the part of the Host Entities or their staff.

V. Rules and Regulations

Participant acknowledges that they and their guests must abide by all standard FHPA Park Rules and specific tournament regulations. The Host Entities reserve the right to modify tournament rules at any time to ensure the safety and fair play of all those involved.

By signing below, I hereby attest that I have read, understand, and agree to the preceding information, obligations, and responsibilities in this Waiver and Release; and that I am voluntarily signing below, intending to be legally bound thereby.

For Participants Under 18 Years of Age (Youth Division)

A parent or legal guardian must sign below for any participant under the age of 18.

By signing below, I hereby attest that I am the parent or legal guardian of the minor participant named below. I have read, understand, and agree to all the preceding information, obligations, and responsibilities in this Waiver and Release on behalf of myself and the minor participant. I explicitly agree to bind myself, the minor child, and our family to all terms of this Agreement, including the Waiver, Release, and Indemnification clauses.
