I am either the parent, legal guardian, or the individual (hereinafter, “Hunter”) participating in the annual John T. Morgan Academy Deer Hunt (the “Deer Hunt”) who is named on the signature page of this Release, Assumption of Risk, Hold Harmless, and Waiver of Liability. For purposes of this Release, Indemnity, Assumption of the Risk, Hold Harmless, and Waiver of Liability Agreement in the event the Hunter is a minor, the undersigned parent or legal guardian agrees both individually and on behalf of the minor Hunter to be bound by the terms of this Agreement
In the event that I am a parent or legal guardian of the Hunter, I have authorized the Hunter to participate in the Deer Hunt. I understand that the Hunter’s participation in the Deer Hunt may include foreseeable and unforeseeable risks and hazardous activities, inherent in hunting, which may expose the Hunter to illness, injury, death or property damage, whether by accident or by negligent, wanton, or intentional misconduct of a third person. I understand and have knowledge of the danger involved in the Deer Hunt, and I hereby agree to expressly assume and accept any and all risk of illness, injury, death or property damage.
I understand and acknowledge that John T. Morgan Academy is not an insurer of the Hunter’s health or well-being or any other party’s behavior or actions and further understand that John T. Morgan assumes no liability, whatsoever, for personal injuries or property damages to the Hunter or to any third persons arising out of the Hunter’s participation in the Deer Hunt.
In consideration of the Hunter being accepted as a paid participant in the annual John T. Morgan Academy Deer Hunt, the Hunter hereby releases, waives, discharges, and covenants not to sue John T. Morgan Academy, its officers, directors, board members, administrators, employees, related entities, agents, representatives, parents, landowners, or anyone assisting in the Deer Hunt activities (all of which are hereby referred to as ‘the Releasees’), from any and all liability to the Hunter and their personal representatives, assigns, heirs, and next of kin for any and all loss or damage and any claims, demands, damages, causes of action, or suits of any kind and particularly on account of injury to the person or resulting in the death of the Hunter, whether caused by the negligence of the Releasees or otherwise while the Hunter is engaged or participating in any authorized activities, including hunting activities, associated with the Deer Hunt, whether on the Releasee’s property or on property being used or provided by landowners for said Deer Hunt.
The Hunter hereby agrees to indemnify, save, and hold harmless the Releasees and each of them from any loss, liability, damage, or cost that may occur due to the participation of the Hunter in the Morgan Academy Deer Hunt and for any authorized hunting activity on any properties whether caused by the negligence of the Releasees or otherwise.
The Hunter hereby assumes full responsibility for any risk of bodily injury or death to the Hunter due to the negligence of the Releasees and otherwise while entering upon engaging in any authorized hunting activity as a part of said Deer Hunt.
The Hunter expressly acknowledges and agrees that the activities of the Releasees may involve the risk of injury and/or death. The Hunter further expressly agrees that this Release, Indemnity Assumption of the Risk, Hold Harmless, and Waiver of Liability Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Alabama and that if any portion or provisions thereof is held invalid, it is agreed that the remaining provisions shall, notwithstanding, continue in full legal force and effect.
Buck Limit and Requirement: The Hunter understands that there is a limit of one (1) antlered buck per day and that the buck must be eight (8) points or above to be harvested. The Hunter further understands that a Management Fee of $100 will be assessed for any violation of this policy. Any additional management requirements will be addressed by the guide and/or landowner prior to the hunt.
The Hunter hereby agrees to follow and obey all State and Federal hunting laws and will hunt in a safe and orderly manner while participating in said Deer Hunt.
The Hunter has read, understands, and voluntarily signs the Release, Indemnity, Assumption of the Risk, Hold Harmless, and Waiver of Liability Agreement, and further agrees that no oral representations, statements, or inducements have been made by the Releasees to the Hunter
