Consultation Agreement
By signing below or electronically agreeing to these Terms and Conditions, the Client acknowledges that they have read, understood, and voluntarily agree to all terms contained herein.
I acknowledge that I am entering into a Consultation Agreement with Fatimah Finney, LMHC (Consultant), that is specific to the duration of the session selection I choose above. The Consultant agrees to provide Consulting Services as outlined in the descriptions above.
1) Consultant-Client Relationship
Consultant agrees to maintain the ethics and standards of behavior established by the American Counseling Association (ACA) and the applicable state licensing boards in which Consultant maintains licensure.
Nature and Scope of Consulting Services
Client understands and agrees that Consulting Services are educational, consultative, and professional development services in nature and are not psychotherapy, mental health treatment, diagnosis, medical care, or crisis intervention services.
Consultant is not acting as Client's treating therapist, counselor, or healthcare provider through participation in these Consulting Services unless explicitly stated in a separate written agreement. Participation in Consulting Services does not establish a therapist–patient relationship.
Description of Consulting
Consulting is a collaborative partnership (defined as an alliance, not a legal business partnership) between Consultant and Client in a thought-provoking and creative process intended to support personal and/or professional growth and development. Consulting may facilitate the creation and development of personal, professional, educational, and/or business goals and strategies for implementing those goals.
Client acknowledges that Consulting is a comprehensive process that may involve different aspects of life, including professional, educational, relational, and personal matters. Client understands that all decisions, actions, and outcomes resulting from participation in Consulting Services remain solely the responsibility of the Client.
Client further understands that Consultant makes no guarantees regarding outcomes, results, certification, personal growth, professional advancement, or specific changes arising from participation in Consulting Services.
Client may terminate participation in Consulting Services at any time, subject to the payment and refund policies outlined in this Agreement.
The Client agrees to communicate honestly, remain open to feedback and participation, and devote the time and energy necessary to fully engage in the program.
2) Informed Consent and Assumption of Risk
Client acknowledges that participation in individual consultation services, discussions, experiential exercises, and related activities may involve emotional discomfort, increased self-reflection, exploration of challenging experiences, or other emotional reactions.
Client voluntarily participates in consultation services and accepts responsibility for their own physical, emotional, and mental well-being before, during, and after consultation sessions.
Client understands that consultation is intended to support professional and/or personal growth and reflection and is not a substitute for psychotherapy, medical care, psychiatric treatment, emergency services, or crisis intervention. Client affirms that they are able to participate in consultation services and are not currently experiencing a crisis situation requiring emergency intervention, acute psychiatric care, or immediate medical treatment.
Client understands that Consultant does not provide emergency services or crisis response. If Client experiences significant distress or believes they may be at risk of harm to self or others, Client agrees to contact appropriate emergency services, crisis resources, or licensed healthcare providers immediately.
3) Services
The parties agree to engage in individual consultation services consisting of the total number of sessions purchased by Client.
All consultation sessions will be individual sessions conducted remotely through the Zoom video conferencing platform. Consultant will be available to Client during session times scheduled and mutually agreed upon by both Client and Consultant.
Consultant may also provide additional consultation-related services outside of scheduled session times, at Client’s request, including but not limited to reviewing documents, offering professional guidance, or providing additional support related to consultation goals. Such additional services will be billed at the rate of $60.00 per 15-minute increment.
4) Schedule, Fees, and Refund Policy
The cost for a single consultation is $200.00. A package of 3 sessions purchased together costs $550.00. A package of 8 sessions purchased together is $1,000.00 and must include review of consultee’s practice with the model.
All fees are non-refundable and non-transferable once payment has been processed, regardless of attendance, participation level, scheduling conflicts, withdrawal, or discontinuation of services, unless otherwise required by law. No refunds, credits, transfers, or make-up sessions will be provided for missed sessions by Client. The time of the Consulting meetings and/or location are determined mutually by Client and Consultant.
The Consultant will initiate all scheduled appointments and provide access links to all video calls. Consultant reserves the right to modify scheduling, meeting dates, or platform logistics as reasonably necessary.
5) Rescheduling and Cancellation by Consultant
If Consultant is unable to conduct a scheduled session, Consultant will make reasonable efforts to reschedule a make-up session at a mutually feasible time for the Client within six (6) months of the originally scheduled session.
Consultant reserves the right to cancel, postpone, suspend, or modify services due to illness, emergency, insufficient enrollment, safety concerns, or circumstances beyond Consultant’s reasonable control.
6) Termination or Suspension of Services
Consultant reserves the right to suspend or terminate Client’s participation at any time if Client behavior is disruptive, threatening, unsafe, unethical, violates this Agreement, infringes upon the rights or well-being of others, or otherwise impairs the consultation process.
In such circumstances, any refund, partial refund, or credit shall be solely at Consultant’s discretion unless otherwise required by law.
7) Confidentiality
This Consulting relationship and information shared during services, whether documented or verbal, is bound by the principles of confidentiality of the ACA Code of Ethics. However, Client understands that Consulting Services are not legally privileged relationships in the same manner as psychotherapy, medical treatment, or legal representation. Thus, communications are not subject to the protection of any legally recognized privilege.
Consultant agrees not to intentionally disclose any information pertaining to the Client without the Client’s written consent except where disclosure is required by law, ethical obligations, court order, or where Consultant reasonably believes there is risk of imminent harm to Client or others.
To support confidentiality, recording, photographing, reproducing, distributing, livestreaming, or sharing any session content, materials, or participant information without Consultant’s prior written consent is strictly prohibited. Unauthorized sharing or recording may result in immediate termination from services without refund and potential legal action.
Client further acknowledges that participation through online platforms such as Zoom and email carries inherent privacy and security risks, including possible unauthorized access or data breaches, and accepts these risks by participating in online services.
8) IFS Certification Disclaimer
Consultant does not guarantee certification eligibility, approval, completion, endorsement, or outcomes from any certifying body or organization.
Attendance requirements are established for program integrity purposes only and do not guarantee certification status or acceptance by any external organization.
9) Limitation of Liability and Release
To the maximum extent permitted by law, Client agrees that Consultant shall not be liable for any direct, indirect, incidental, consequential, emotional, psychological, financial, special, or other damages arising out of or related to participation in Consulting Services.
Client voluntarily releases, waives, and discharges Consultant from any and all claims, liabilities, demands, causes of action, damages, or losses related to participation in Consulting Services, except in cases of gross negligence or willful misconduct where prohibited by law.
Client further agrees to hold harmless and indemnify Consultant from claims arising from Client’s participation, conduct, or use of services.
10) Privacy and Communications
Client understands that personal information collected during registration and participation may include the Client’s name, email address, payment information, attendance records, communications, and other information reasonably necessary for program administration.
Client information will be maintained and processed in accordance with applicable privacy and confidentiality standards, including HIPAA privacy principles where applicable.
Client consents to the use of the Client’s name and email address for purposes related to participation in the consultation sessions, including:
- Scheduling communications
- Zoom invitations and reminders
- Distribution of program materials
- Administrative and customer support communications
Consultant will make reasonable efforts to protect Client information but cannot guarantee absolute confidentiality or security of electronic communications and online systems.
11) Entire Agreement
This document reflects the entire agreement between Consultant and Client and supersedes all prior oral or written communications, understandings, or representations regarding Consulting Services.
This Agreement may not be amended, modified, or supplemented except in writing signed or acknowledged electronically by both Consultant and Client.
