GOLF CART RENTAL AGREEMENT & LIABILITY WAIVER
RENTAL AGREEMENT
This Agreement is entered into between Tretter No Better LLC / TNB Golf Carts ("Owner") and the Client named above ("Renter") as of the contract date above. The golf cart(s) is hereby rented for the agreed-upon times and dates. If Renter retains the property after expiration, such retention constitutes additional rental at the daily rate under the same terms. Renter represents familiarity with the use and operation of said property. Renter shall not sublease or re-rent the equipment. Renter shall return all equipment in the same condition as received. Renter expressly acknowledges personal liability for all costs to repair damages, including Owner's attorney fees incurred in collection.
WAIVER OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION
In consideration of being permitted to use Owner's golf cart(s), Renter hereby releases, waives, discharges, and covenants not to sue Owner, its members, officers, employees, and agents from any and all liability for claims resulting in personal injury, illness including death, and property loss arising from use of the cart(s). Renter acknowledges that operating a golf cart carries inherent risks ranging from minor injuries to catastrophic injuries including paralysis and death, and accepts sole responsibility for assessing those hazards. Renter agrees to DEFEND, INDEMNIFY, AND HOLD HARMLESS Owner from any and all claims, costs, attorney's fees, and damages arising from Renter's use of the cart(s). This waiver is intended to be as broad and inclusive as permitted by the laws of the State of California. If any portion is held invalid, the remainder shall continue in full legal force.
CALIFORNIA VEHICLE CODE — OPERATOR REQUIREMENTS
Per California Vehicle Code (CVC §21115 et seq.), golf carts shall not be operated on any public roads. Owner requires operators to be at least 18 years of age and Renter must be at least 21 years of age. All operators must comply with California traffic laws. Golf carts as defined under California law (under 1,300 lbs, max 15 mph) are restricted to private property and designated areas unless meeting street-legal LSV/NEV equipment standards (TNB golf carts do not qualify). Renter assumes all responsibility for operating the cart in compliance with applicable California and local laws.
GOLF CART RULES & REGULATIONS
1. Renter must be a minimum of 21 years of age to rent. Operators must be at least 18 years of age.
2. Use lights after sunset. Turn off cart and lights when not in use to prevent battery drain.
3. No horseplay, racing, off-roading, or other misuse. Do not endanger passengers, pedestrians, or property.
4. Obey all applicable traffic and road laws. Park on level ground; remove key when not in use.
5. Maximum 1 person per seat. Back seat weight limit: 250 lbs. No passengers on footrests.
6. Report any malfunctions immediately to TNB Golf Carts: (530) 794-8787.
7. Alcohol is prohibited during cart operation.
8. Gas carts: Premium or Non-Ethanol fuel only. Electric carts: do not use charger outdoors if it is raining.
CANCELLATION & REFUND POLICY
A 50% deposit is paid via Stripe at the time of signing to reserve the equipment and the rental date, with the remaining 50% balance charged to the same card on the rental day. If Renter cancels, the deposit is refundable except for a non-refundable booking fee. The parties agree this booking fee is a reasonable pre-estimate of Renter's costs of reserving the date, declining other bookings, and preparing equipment (cleaning, charging, and inspection) — costs that are impractical to calculate precisely at signing.
• 3+ carts: Cancellations 14+ days in advance — full refund. Less than 14 days — refund of the deposit minus a non-refundable booking fee of $150.
• 1–2 carts: Cancellations 48+ hours in advance — full refund. Less than 48 hours — refund of the deposit minus a non-refundable booking fee of $75.
• No-shows forfeit the booking fee only; the remainder of the deposit is refunded.
If a cancellation occurs after the 50% balance has been charged, the same booking fee applies and the remainder of all amounts paid is refunded. Stripe processing fees incurred on any payment are non-refundable and may be deducted from any refund. Refunds are issued promptly upon confirmation of cancellation and typically post to Renter's card within 5–10 business days, depending on Renter's card issuer.
INSURANCE REQUIREMENT
Prior to delivery of any rental cart(s), Renter must provide Tretter No Better LLC / TNB Golf Carts with a valid Certificate of Insurance (COI) evidencing a current insurance policy that: (a) names Tretter No Better LLC / TNB Golf Carts as an Additional Insured; (b) provides coverage for loss, theft, and/or damage to the rented cart(s) with minimum limits sufficient to cover the full replacement value of the cart(s) rented; and (c) provides coverage for bodily injury and property damage liability arising from Renter's use and operation of the cart(s). Renter must email the COI to info@tnbgolfcarts.com no later than the fully refundable cancellation deadline for this booking (14 days before the rental day for 3+ carts; 48 hours before the rental day for 1–2 carts). THE RENTAL IS NOT CONSIDERED RESERVED UNTIL A SATISFACTORY COI HAS BEEN RECEIVED AND CONFIRMED BY OWNER.
If a satisfactory COI is not received and confirmed by that deadline, the booking shall be treated as cancelled and the deposit refunded in full. Renter acknowledges that Owner carries no insurance covering loss, damage, or liability arising from Renter's possession or operation of the rented cart(s), and that Renter is solely responsible for obtaining and maintaining adequate insurance coverage for the duration of the rental period.
DELIVERY FEE ADJUSTMENT
The delivery fee is based on the one-way distance from Vacaville, CA selected by Renter and is subject to confirmation by TNB Golf Carts. If the selected distance tier is incorrect, the delivery fee and the remaining balance will be adjusted to the correct tier, and Renter will be notified of the change before the rental day.
RENTAL DAY / RETURN TIME
A rental day ends at 12:00 PM (noon) on the pickup date. Carts returned after noon are charged an additional full day at the daily rental rate.
PAYMENT — STRIPE
Payment for this rental is processed securely via Stripe, a PCI-compliant payment processor. A 50% deposit of the Total Due — calculated on the rental charge, delivery fee, and applicable California sales tax — is charged to Renter's card at the time of signing. The remaining 50% balance is charged to the same securely retained card on the rental day (the delivery date). By signing this agreement, Renter authorizes TNB Golf Carts to charge Renter's card for the 50% deposit at signing and the remaining 50% balance on the rental day, together equaling the Total Due. Card information is entered directly into Stripe's secure payment field and is processed by Stripe; TNB Golf Carts does not store Renter's card number.
CREDIT CARD AUTHORIZATION — INCIDENTALS
The Stripe payment method used for the rental above is retained securely by Stripe for the duration of the rental period. The card is tokenized by Stripe — TNB Golf Carts ("Owner") does not store or have access to Renter's raw card number at any time. Renter authorizes Owner to charge the retained payment method, after the rental total has been paid, only for: (a) damages to the cart(s) beyond normal wear and tear; (b) late return fees at the daily rental rate; (c) excessive cleaning fees if the cart is returned in unacceptable condition; and (d) any accessories, equipment, or fuel charges incurred during the rental period. Renter will be notified of any incidental charge before the card is billed. This authorization is limited to the four categories above and expires upon return of the cart(s) and resolution of all charges.
GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Solano County, California. In the event of a dispute, the prevailing party shall be entitled to recover reasonable attorney's fees and costs. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
This document constitutes the entire agreement between Owner and Renter. No verbal representations alter this Agreement. Renter confirms receipt of the cart(s) in good working order and acknowledges reading, understanding, and voluntarily agreeing to all terms herein, including the waiver of substantial legal rights.
