Keegan and Company — Backyard Trail Run

This waiver applies to the Keegan and Company Backyard Trail Run event (the "Event"), a recreational trail running event held at 138 Piggabeen Rd, Currumbin Valley QLD 4223, organised by Keegan and Company Pty Ltd

I acknowledge that participation in the Event involves inherent risks, which may include but are not limited to:

• Physical injury, including falls, sprains, fractures, or musculoskeletal injury
• Cardiovascular events including cardiac arrest
• Death
• Hilly, uneven, and potentially slippery terrain
• Extreme weather or heat conditions
• Contact with other participants
• Dehydration or heat-related illness
• Aggravation of any pre-existing medical condition

I confirm that I am physically fit and have no medical condition that would prevent me from safely participating in this activity. If I have any doubt, I have sought medical clearance prior to attending.

To the fullest extent permitted by law, I agree to release, indemnify, and hold harmless Keegan and Company, its organisers, volunteers, staff, sponsors, landowners, and any associated parties from any claim, loss, damage, or liability arising from my participation in the Event, including but not limited to:

• Personal injury or death
• Loss or damage to personal property
• Aggravation, acceleration, or recurrence of any pre-existing condition or disease
• Any other harm or disadvantage to myself or a third party

I understand that this release does not apply to significant personal injury caused by reckless conduct on the part of the organiser, as required under the Competition and Consumer Act 2010.

Under the Australian Consumer Law, statutory guarantees apply to the supply of certain recreational services. By signing this waiver, you agree that the liability of Keegan and Company for any death, physical or mental injury, disease, or related condition arising from the supply of recreational services is excluded, to the extent permitted by law.

I consent to photographs, video, and audio recordings being taken of me during the Event, and grant Keegan and Company a non-exclusive, royalty-free licence to use these materials for promotional, editorial, and social media purposes.

I agree to:

• Follow all instructions from event organisers and marshals
• Carry my own water as required
• Stay on the marked course and not deviate without authorisation
• Withdraw from the Event if I feel unwell or unsafe at any point
• Respect the land, property, and other participants
• Not participate under the influence of alcohol or prohibited substances

I have read and understood this waiver. I am 18 years of age or older. I sign this document voluntarily, without inducement, and with full understanding of its terms.

Note: This waiver is to be completed by participants aged 18 years and over. For participants under 18, a parent or guardian must sign on their behalf. Please seek independent legal advice if you are unsure about the terms of this document.
