Section 1

In consideration of being permitted to participate in the ATV/UTV riding event, as well as any related events and activities jointly sponsored by The Best Dam Ride Ever, The Hermitage, Jefferson Township, Patagonia, and West Middlesex Fire Departments, and intending to be legally bound, the undersigned:

1. Agrees that, prior to participating, they will inspect the facilities and equipment to be used, and if they believe that anything is unsafe, they will immediately advise event officials of such conditions and refuse to participate.
2. Acknowledges and fully understands that each participant will be engaging in activities that can involve the risk of serious injury, including permanent disability and death, and that severe economic losses may result from from their own actions, as well as the action, inactions, or negligence of others, the rules of participation, the condition of the premises, or of any of the equipment used. Further, that there may be other risks that are not known, nor reasonably foreseeable at this time. The participant understands these risks and further understands that they are riding at their own risk.
3. Assumes all of the foregoing risks and accepts personable responsibility for the damages following such injury, permanent disability, or death.
4. Releases, waives, discharges, and covenants not to sue the Hermitage Volunteer Fire Department, the Jefferson Township Volunteer Fire Department, the West Middlesex Volunteer Fire Department, the Patagonia Fire Department the City of Hermitage, Jefferson Township, Delaware Township, Pymatuning Township, South Pymatuning Township, the Borough of Sharpsville, Lackawannock Township, Wilmington Township in Mercer County, the United States Army Corps of Engineers, The Jefferson Township Fair Board, or the Mercer County Trails Association.
5. Agrees to abide by and acknowledges their familiarity and understanding of all PA State ATV laws and regulations.

ATV Riding Rules and Enforcement

Section 2

Agrees to abide by and acknowledges their familiarity and understanding of the Event Rules which are as follows:

1. All riders must have read and signed a Release of Liability form as well as know all of the PA ATV Laws.
2. All riders must stay on the trail route and follow all trail signs.
3. If you need to stop on the route, avoid being a hazard and stay off of private property. Use a safe adequate pull off.
4. Follow a 25 MPH Speed Limit along the entire route.
5. All traffic laws and signs must be followed.
6. Follow the flow of traffic and keep right.
7. All ATVs must meet PA State Laws and hold valid registration and Liability Insurance for their state.
8. In addition to any safety equipment required by PA State Laws, riders are required to wear a helmet with face shield or goggles, and boots.
9. All riders agree to ride in a safe and appropriate manner at all times.

Failure to follow Rules and Regulations may lead to removal from the event without a refund.

THE UNDERSIGNED HAS READ THE ABOVE WAIVER AND RELEASE, UNDERSTANDING THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND DOES SO VOLUNTARILY.

NOTICE:

All riders who are under the age of 18 must be accompanied by a parent or legal guardian. NO participants under the age of 18 are permitted unless they are accompanied by a parent or legal guardian that completes a separate waiver for each minor.

THE UNDERSIGNED AND THEIR PARENT AND/OR LEGAL GUARDIAN HAS READ THE ABOVE WAIVER AND RELEASE, UNDERSTANDING THAT THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND DOES SO VOLUNTARILY.
