Participant Release, Waiver of Liability & Indemnification Agreement.
2026 Season Important Notice
This is a legally binding agreement. By completing the online registration and acknowledging this waiver electronically, a parent or legal guardian waives certain legal rights on behalf of themselves and their minor child, including the right to sue for negligence.
1. Description of Activity. The Jerry McGee Memorial Junior Golf League is a six-week youth golf program operated by the East Palestine Country Club Youth Golf Initiative in partnership with East Palestine Country Club. Activities may include golf instruction, practice facility use, on-course play, golf cart transportation, clubhouse activities, and family events.
2. Assumption of Risk Participation in golf and related activities involves inherent risks, including being struck by golf equipment, falls, golf cart incidents, weather exposure, insect bites, dehydration, pre-existing medical conditions aggravated by activity, and other risks associated with outdoor recreation. Participation may result in serious injury, disability, or death. These risks are voluntarily accepted.
3. Release and Waiver of Liability In consideration of participation in the Program, the parent or legal guardian releases, waives, and agrees not to sue the East Palestine Country Club Youth Golf Initiative, East Palestine Country Club, and their officers, directors, employees, volunteers, coaches, agents, representatives, and affiliates for any claims arising from participation in the Program, including claims alleging negligence to the fullest extent permitted by law.
4. Indemnification The parent or legal guardian agrees to indemnify, defend, and hold harmless the released parties from claims, damages, costs, expenses, and liabilities arising from the participant’s involvement in the Program.
5. Emergency Medical Authorization If emergency medical treatment is required and a parent or guardian cannot be reached, Program representatives may obtain emergency care for the participant. The parent or guardian remains responsible for any resulting medical expenses. Medical conditions, limitations, or allergies must be disclosed during registration.
6. Photo and Media Release Unless otherwise indicated during registration, permission is granted for photographs and video recordings of participants to be used for promotional, educational, and organizational purposes without compensation.
7. Code of Conduct Participants are expected to demonstrate respect, sportsmanship, integrity, and appropriate behavior. The Organization may remove a participant whose conduct is unsafe, disruptive, or disrespectful.
8. Registration Fee and Refund Policy Registration fees are non-refundable once the season begins. If the Program is canceled due to circumstances beyond the Organization’s control, a prorated refund may be considered at the discretion of the Organization.
9. Severability and Governing Law If any provision of this Agreement is deemed unenforceable, the remaining provisions remain in effect. This Agreement is governed by Ohio law, and disputes shall be subject to the courts of Columbiana County, Ohio.
Electronic Acknowledgment By completing the online registration form, the parent or legal guardian acknowledges that they have read, understood, and voluntarily agreed to all terms of this waiver on behalf of themselves and the participant. Electronic acknowledgment through the registration platform serves as a legally binding acceptance of this Agreement.
