WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT
In consideration of being allowed to participate on behalf of Crystal’s World of Dance and or Project C.A.M.P and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,I , for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (insert name of sports organization) their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors ofpremises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

Acknowledgment of Inherent Risks

I, the undersigned parent or legal guardian, hereby acknowledge that participation in competitive cheerleading, tumbling, stunt training, and dance activities involves inherent risks of physical injury. These risks include, but are not limited to:

• Scrapes, bruises, muscle strains, pulls, or tears.

• Broken bones, dislocations, concussions, or spinal injuries.

• Catastrophic injury, permanent paralysis, or death.

I understand that these risks arise from jumping, stunting, tumbling, tossing, and rigorous physical exertion inherent to indoor recreational and competitive cheer and dance. I acknowledge that my child is participating voluntarily with my full knowledge and consent of these risks.

Medical Fitness and Authorization

• Fitness Certification: I certify that the participant is physically fit and mentally capable of participating in strenuous cheer and dance activities, and does not have any medical conditions or restrictions that have not been disclosed in writing to the coaching staff.

• Emergency Medical Treatment: In the event of an illness or injury during any practice, competition, or CWOD-sanctioned event, I hereby grant permission to the staff, coaches, or representatives of Crystal’s World of Dance to authorize and secure emergency medical treatment (including ambulance transport, X-rays, anesthesia, or surgery) if a parent/guardian cannot be reached immediately. I agree to assume full financial responsibility for all medical costs incurred.

Release of Liability and Indemnity Agreement

In consideration for allowing my child to participate in the CWOD Ultimate All-Stars program, I, on behalf of myself, my child, our heirs, executors, and administrators, hereby:

Release, Waive, and Forever Discharge Crystal’s World of Dance, CWOD Ultimate All-Stars, its owners, directors, officers, coaches, independent contractors, employees, volunteers, and facility landlords (collectively referred to as the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of negligence, personal injury, property damage, or wrongful death occurring during or as a result of participation in any CWOD activity.. Indemnify and Hold Harmless the Released Parties from any attorney's fees, court costs, or financial liabilities resulting from any lawsuit or claim brought by myself, my child, or on behalf of my child against the Released Parties.

Rules, Conduct, and Property Damage

I agree that my child will abide by all facility rules, safety guidelines, and coach instructions. CWOD Ultimate All-Stars reserves the right to terminate a participant’s enrollment without a refund if the participant or parent engages in behavior that threatens the safety, well-being, or reputation of the team. I accept financial responsibility for any property damage caused willfully or through gross negligence by my child at the facility or during travel events.

6. Photo and Media Release (Optional but Recommended)

I hereby grant Crystal’s World of Dance and CWOD Ultimate All-Stars the absolute right and permission to take, use, and publish photographs or video recordings of my child during practices, performances, and competitions for promotional, marketing, social media, or website purposes without further compensation.
