BOAT POKER RUN PARTICIPANT WAIVER & RELEASE OF LIABILITY
Event: Great Sacandaga Lake Poker Run/Fun Run Date: June 20, 2026
Waiver of Liability, Assumption of Risk & Indemnity Agreement
In consideration of being permitted to participate in the Sacandaga Lake Poker Run (the “Event”), produced and/or organized by the Sacandaga Lake Poker Run, its organizers, sponsors, volunteers, venues, and associated entities, including but not limited to Mountain Valley Hospice (collectively referred to as the “Released Parties”), the undersigned participant agrees to the following:
1. Voluntary Participation & Assumption of Risk
I understand and acknowledge that participation in boating events involves inherent and significant risks, including but not limited to collisions, equipment failure, wake or water hazards, weather conditions, operator error, negligent acts of others, fire, drowning, serious bodily injury, death, and property damage.
I voluntarily choose to participate in the Event and knowingly assume full responsibility for all risks of injury, death, property damage, or any other loss arising from participation in the Event, whether caused by negligence of the Released Parties or otherwise.
I further acknowledge that I am physically and mentally capable of participating in the Event and that I participate entirely at my own risk.
2. Release of Liability & Covenant Not to Sue
I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE the Released Parties from any and all liability, claims, demands, actions, causes of action, damages, losses, costs, or expenses of any kind arising out of or related to my participation in the Event, including claims arising from negligence of the Released Parties or otherwise.
This release applies to any claims for personal injury, illness, death, property damage, economic loss, or any other damages suffered by me, my passengers, heirs, assigns, personal representatives, or next of kin.
3. Indemnification & Hold Harmless
I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including attorney’s fees, arising out of or related to:
My participation in the Event;
The participation of any passengers or guests aboard my vessel;
My operation or use of any vessel during the Event; or
Any violation of applicable laws, regulations, or Event rules by me or anyone aboard my vessel.
4. Captain’s Responsibility
I understand and agree that the Captain/operator of each vessel is solely responsible for the safe operation of the vessel and the conduct and safety of all passengers and occupants aboard.
The Captain shall ensure that all passengers and crew members have read and signed this waiver prior to participation. If any passenger or crew member has not signed a waiver, the Captain assumes full responsibility and liability for that individual.
The Captain further agrees to ensure that:
The vessel is operated in a safe and lawful manner at all times;
All required safety equipment is onboard and in working condition;
All occupants comply with applicable boating safety laws and Event rules.
5. Compliance with Laws & Safety Rules
All participants agree to comply with all local, county, state, and federal laws, regulations, ordinances, and boating safety requirements, including all New York State boating laws.
Participants shall not operate or occupy a vessel while under the influence of alcohol, illegal drugs, or any substance that may impair judgment or safe operation of a vessel.
All operators and participants agree to follow all Event safety requirements, including:
The use of engine cut-off lanyard/kill switches where required by law;
The wearing and availability of properly fitted U.S. Coast Guard-approved personal flotation devices (PFDs) as required by law and Event rules;
Compliance with no-wake zones and safe boating practices.
Any participant violating laws or Event rules may be removed or disqualified from the Event without refund and may be subject to legal consequences.
6. Responsibility for Vessel & Occupants
I acknowledge that I am solely responsible for my vessel, its operation, its occupants, and any property brought to or used during the Event.
I assume full responsibility for any bodily injury, death, or property damage involving myself, my vessel, passengers, crew, or guests arising from participation in the Event.
7. Media Release
I understand and agree that photographs, video recordings, audio recordings, or other media may be captured during the Event featuring me, my passengers, or my vessel.
I grant the Event organizers and Released Parties permission to use such photographs, videos, recordings, or likenesses for promotional, advertising, marketing, or other lawful purposes in any medium without compensation or further approval.
8. Severability
I expressly agree that this Waiver of Liability and Indemnity Agreement is intended to be as broad and inclusive as permitted by the laws of the State of New York.
If any portion of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. Governing Law & Venue
This agreement shall be governed by and construed in accordance with the laws of the State of New York. Any legal action or proceeding arising out of or relating to this agreement or the Event shall be brought exclusively in the courts of the State of New York.
10. Acknowledgment & Signature
I HAVE CAREFULLY READ THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT.
