In consideration of participating in AKP Sports Foundation’s Sports Academy and related events and activities (the “AKP Sports Academy”), I {1stChild}, {2ndChild,} {3rdChild,} {4thChild} (“Participant”) acknowledge, and agree with the following provisions:
1. Acknowledgment and Assumption of Inherent Risks. I understand and acknowledge that participation in physical activities at the AKP Sports Academy involves inherent risks of serious bodily injury, permanent disability, paralysis, and death. These risks include, but are not limited to: (a) physical contact with other participants, athletic equipment, or objects; (b) slipping, tripping, or falling due to court surfaces, field conditions, or other hazards; (c) overexertion, heat-related illness, or cardiovascular events; (d) communicable diseases, including MRSA, influenza, and COVID-19; (e) travel to and from the event venue; and (f) the negligent or reckless conduct of other participants, spectators, or third parties. I fully understand these risks, voluntarily accept them, and assume full responsibility for any injury, loss, or damage I may suffer as a result of my participation, whether caused by the negligence of the Released Parties (as defined below) or otherwise.
2. I acknowledge and agree to comply with the stated, written, and customary terms and conditions for participation. If, however, I observe any unusual, significant hazard during my participation in the AKP Sports Academy, I will remove myself from participating and bring such hazard to the attention of the nearest official immediately.
3. I acknowledge that I am solely responsible for all costs related to any potential medical treatment or transportation for any injuries sustained during my participation in the AKP Sports Academy. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of AKP Sports Foundation, including but not limited to their agents, representatives, partners, and employees, and assume full responsibility for my participation. I am voluntarily participating in the AKP Sports Academy with knowledge of the danger involved and hereby agree to accept all risks related to personal injury, property damage, or any other harm that may arise in connection with my participation in the AKP Sports Academy and related events and activities.
4. Waiver, Release, and Indemnification. On behalf of myself, my heirs, assigns, personal representatives, and next of kin, I hereby forever release, waive, and discharge AKP Sports Foundation, its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and the owners and lessors of premises used to conduct the AKP Sports Academy (collectively, the “Released Parties”), from any and all claims, demands, liabilities, causes of action, losses, or damages for injury, damage to property, illness, disability, or death arising out of or related to my participation in the AKP Sports Academy, whether arising from the NEGLIGENCE of the Released Parties or otherwise, to the fullest extent permitted by applicable law. This release does not extend to claims arising from the gross negligence, willful or intentional misconduct, or violation of law by the Released Parties. I understand that by signing this Agreement, I am giving up my right to sue the Released Parties for any injuries or damages I may suffer. I further agree to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, claims, demands, losses, damages, and expenses, including reasonable attorneys’ fees, incurred by the Released Parties as a result of any claim or lawsuit brought by me, on my behalf, or by any third party arising out of my participation in the AKP Sports Academy.
5. Media Release and Likeness Authorization. I hereby irrevocably grant to AKP Sports Foundation, its successors, and assigns the perpetual, worldwide right to photograph, record, film, and otherwise capture my name, image, voice, and likeness (“My Likeness”) in any media now known or hereafter developed, in connection with the AKP Sports Academy. I grant AKP Sports Foundation the right to use, reproduce, modify, publish, distribute, and publicly display My Likeness for any lawful purpose, including for promotional, advertising, and fundraising purposes, without any compensation to me. I waive any right to inspect or approve the finished product and release the Released Parties from any and all claims related to the use of My Likeness, including claims for invasion of privacy, right of publicity, or defamation.
6. I acknowledge that this Waiver and Release of Liability Agreement (“Agreement”) contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement.
7. Authorization for Emergency Medical Treatment. In the event of an injury or medical emergency, I authorize AKP Sports Foundation and its representatives to arrange and consent to emergency medical care on my behalf. I consent to any medical treatment deemed necessary by attending medical personnel. I agree to be financially responsible for all costs related to such treatment and transport, and I understand that AKP Sports Foundation does not provide health, medical, or disability insurance coverage for participants.
8. Governing Law; Severability. This Agreement shall be governed by and construed in accordance with the laws of the state in which the relevant AKP Sports Academy event is held, without regard to conflict of law principles. The parties agree that any legal action arising out of this Agreement must be brought exclusively in the state or federal courts located in the state where the event occurred. If any portion of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect. The provisions of this Agreement shall survive the conclusion of the AKP Sports Academy and continue in full force and effect thereafter.
I HAVE READ THIS AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT, INCLUDING THE RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT PERMITTED BY LAW.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
I am the parent or legal guardian of the minor named above. I have the legal right to consent to the minor’s participation in the AKP Sports Academy. By signing below, I release and agree to hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in the AKP Sports Academy, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. I personally and fully assume all risks and responsibilities as per this agreement on behalf of the minor child named above.
