THIS AGREEMENT (THE “AGREEMENT”) INCLUDES A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS INCLUDING CERTAIN RIGHTS TO SUE OR CLAIM COMPENSATION. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.Terms of Service & Cancellation PolicyI am voluntarily enrolling in a training session that will have multiple classes, offered by Pet Network Humane Society. I understand that training fees are non-refundable (unless cancelled on at least 14 days’ notice as set forth below) and non-transferable, and that no "make-up" Classes will be available to attend with my dog(s) should I fail to appear at any Class. I acknowledge and agree that Pet Network Humane Society (“Pet Network”) or my instructor may dismiss me from any and all Classes, at any time, with or without cause, and in such event, no portion(s) of my pre-paid training fees will be refunded to me for any reason.Class dates may be subject to change due to inclement weather, etc. at the discretion of the instructor. Clients will be notified of any schedule changes by email at least 2 hours in advance, asking for a reply email as confirmation of receipt of the notice of schedule change. Please be sure to add us to your "allowed" list of email senders and to keep us informed of your current contact information. Pet Network will not be responsible for classes missed due to lack of correct/current contact information provided by the client.Please note that our shelter number (775-832-4404) is a landline and does not receive texts.If you are unable to attend the training session for which you registered, and you let us know at least 14 days in advance, Pet Network will happily refund your session fee. No refunds will be made available to clients who fail to notify us at least 14 days before the start of their first class in the session.Release of Liability, Waiver of Claims, Assumption of Risks, Indemnity AgreementI hereby certify that I am over the age of 18, and that, to the best of my knowledge, any dog I may bring to Classes is in good health, free of communicable diseases, and has had all precautionary vaccinations and protection which may be required by law and/or deemed appropriate for the safety and well-being of all human and canine participants attending Classes. I agree that it is my sole responsibility to determine whether any dog I may bring to Classes is sufficiently fit and healthy enough to participate in the Classes.I agree that I am personally responsible for the safety and actions of myself and my dog(s) while attending in-person Dog Training Classes offered by Pet Network. I agree to comply with all of Pet Network’s safety procedures and rules, including but not limited to all policies, guidelines, signage and instructions, written and/or verbal, set forth by Pet Network or any of its staff members. I understand and agree that if I learn that I have been exposed to or test positive for COVID-19, I must notify Pet Network immediately, and that neither I nor my dog(s) will be permitted to return to in-person Classes during the CDC-recommended quarantine period. Assumption of RiskI hereby recognize the potential for injury in attending Classes and agree to assume full responsibility and/or liability for any and all risks of damage and/or injury to myself, my dog(s), my property, and any and all other persons and animals attending Classes. I will not hold Pet Network responsible for any injury, harm, or damage that occurs during Classes, nor sue Pet Network or its staff for any damages resulting therefrom.I am aware that while participating in Classes, I and my dog(s) may be exposed to a variety of environmental conditions which include, but are not limited to, all types of vehicular traffic, interaction with people and other animals, and exposure to adverse weather. I further acknowledge that dog training may be a hazardous activity in which damage or injury to dogs and people may occur.I acknowledge and understand that participation in Classes and dog training activities carries with it certain inherent risks that cannot be eliminated regardless of the care taken by the instructor or facility to avoid injuries. The specific potential risks vary from one activity to another, ranging from minor injuries to major and catastrophic injuries. These risks include, but are not limited to:1. Animal Behavior Risks: Unpredictable actions of dogs, including but not limited to biting, scratching, jumping, lunging, fighting, chasing, or otherwise acting aggressively or fearfully toward people, other dogs, or property.2. Physical Injury Risks: Bodily injury to participants or third parties resulting from contact with dogs, equipment, or other participants; slips, trips, or falls; strains or sprains from handling, restraining, or lifting dogs; or injury due to sudden movement or pulling on leashes.3. Environmental and Equipment Risks: Hazards related to indoor or outdoor training areas, such as uneven or slippery surfaces, obstacles, weather conditions, or defective or misused training equipment, collars, leashes, or harnesses.4. Health and Disease Risks: Exposure to allergens, bacteria, parasites, or viruses that may be transmitted by dogs or present in the environment, including zoonotic diseases such as ringworm, kennel cough, or leptospirosis.5. Other Participants and Third-Party Risks: Injuries or damages caused by the acts or omissions of other participants, spectators, or their animals, or by dogs not under the direct control of the trainer or facility.6. Behavioral Uncertainty: The risk that any dog, including the participant’s own dog, may not behave as expected or may fail to respond to training methods.7. Transportation and Ancillary Risks: Risks associated with travel to, from, or between training sessions, and any incidental activities related to participation in the training program.8. COVID-19: Risk of contracting COVID-19 while attending in-person Classes.I, for myself, my dog(s), any other persons who attend Classes as my guests and their dogs, understand and EXPRESSLY ASSUMES ALL INHERENT RISKS AND DANGERS, including those that may arise from the negligence of the Released Parties (as defined herein), and accept full responsibility for any injury, loss, damage, or expense that may result from participation in the training session.I further expressly acknowledge and assume all additional risks and dangers that may result in property damage, physical injury, and/or death, which may be above and beyond the inherent dangers and risks of the activity.I UNDERSTAND THAT THE DESCRIPTION OF THE RISKS IN THIS AGREEMENT IS NOT COMPLETE, AND VOLUNTARILY CHOOSE TO PARTICIPATE IN AND EXPRESSLY ASSUME ALL RISKS AND DANGERS OF THE ACTIVITY AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM, WHETHER OR NOT DESCRIBED HERE, KNOWN OR UNKNOWN, INHERENT OR OTHERWISE.Release of Claims, Waiver, and IndemnificationI hereby consent to participation in the Classes, recognize the potential for injury, and I agree, to the greatest extent permitted by applicable law, for myself, my heirs, executors, personal and/or legal representatives or assigns, do hereby release, waive, discharge, indemnify, hold harmless, and covenant not to sue Pet Network Humane Society, any Pet Network instructor, their respective employees, agents, officers, directors, or any person acting on their behalf or at their request, and any other participants in Classes or invitees thereof (hereinafter referred to as “Released Parties”), with respect to ANY INJURY, INCLUDING DEATH, LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, OR EXPENSES, INCLUDING COURT COSTS AND REASONABLE ATTORNEYS’ FEES OF ANY KIND OR NATURE, WHICH MAY ARISE OUT OF, RESULT FROM, OR RELATE TO MY PARTICIPATION IN THE ACTIVITY OR THE PARTICIPATION OF MY DOG(S) (COLLECTIVELY, “CLAIMS”), INCLUDING, BUT NOT LIMITED TO, CLAIMS CAUSED IN WHOLE OR IN PART BY THE ALLEGED OR ACTUAL SOLE NEGLIGENCE OF PET NETWORK OR BY PET NETWORK’S NEGLIGENCE, CLAIMS FOR BREACH OF ANY CONTRACT AND/OR EXPRESS OR IMPLIED WARRANTY, AND CLAIMS FOR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE. THE FOREGOING PROVISION SHALL NOT APPLY TO CLAIMS CAUSED IN WHOLE OR IN PART BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF PET NETWORK. I UNDERSTAND THAT THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR THE CONSQUENCES OF THEIR OWN NEGLIGENCE, THAT IS, THEIR FAILURE TO USE REASONABLE CARE IN ANY WAY, INCLUDING BUT NOT LIMITED TO THEIR FAILURE TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS OF PARTICIPATION IN THE CLASSES.I AGREE TO DEFEND AND INDEMNIFY EACH RELEASED PARTY FOR ALL LIABILITY AND CLAIMS, INCLUDING ATTORNEYS’ FEES, WHETHER ARISING IN WHOLE OR IN PART FROM MY PARTICIPATION IN THE TRAINING SESSION OR FROM ANY MISREPRESENTATIONS I HAVE MADE IN THIS AGREEMENT.Publicity & Consent to Use Photographs/VideosI hereby grant to Pet Network, any Pet Network instructor, and/or any person acting on their behalf or at their request the irrevocable and unrestricted right to use and publish photographs and/or videos of me, my dog(s), and any persons accompanying me to any class, private lesson or event, and photographs and/or videos in which I, my dog(s), and any persons accompanying me may be included, for editorial, trade, advertising, social media, and any other purpose and in any manner and medium, and to alter and composite the same without restriction and without my inspection or approval. I hereby release Pet Network, any Pet Network instructor and/or any person acting on their behalf from all claims and liability relating to said photographs and/or videos.Miscellaneous ProvisionsI fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I agree to the terms of this agreement freely and voluntarily, and intend my agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law. I understand and agree that this Agreement will also apply to any and all Classes I attend in the future.This Agreement shall, in all respects, be governed, construed, applied, and enforced in accordance with the internal laws of the State of Nevada, and that exclusive jurisdiction of any claims arising out of this agreement shall be in a court of competent jurisdiction in the State of Nevada. If any language of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that language shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining language in this Agreement.I agree that this Agreement represents the complete understanding between the parties regarding the subject matter hereof and no oral representations, statements, or inducements have been made apart from this Agreement. This Agreement supersedes all other agreements, written or oral, previously made between myself and any of the Released Parties.Acknowledgement and AgreementI AM AT LEAST 18 YEARS OF AGE AND FULLY COMPETENT. I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS, AND I AGREE TO ALL THE TERMS AND CONDITIONS STATED ABOVE. I AM AWARE THAT THIS IS A RELEASE OF ALL LIABILITY AND A BINDING CONTRACT.
