INFORMED CONSENT, ASSUMPTION OF RISK, AND WAIVER OF LIABILITY & MEDIA RELEASE
Vegas For Athletes (VFA) Summer Games
This Waiver and Release becomes effective upon registration and applies to all activities related to the VFA Summer Games, including pre-event, event-day, and post-event activities.
1. ACKNOWLEDGMENT OF EVENT AND ATHLETIC RISKS
I understand that participation in athletic events involves inherent and significant risks, including but not limited to serious bodily injury, permanent disability, concussion or head injury, cardiac events, illness, and death.
I understand that these risks may result from my child’s actions, the actions of others, environmental or weather conditions, equipment or facility conditions, or negligence. I knowingly and voluntarily choose to allow myself or my child to participate with full knowledge and acceptance of these risks.
2. HEART SCREENING INFORMATION AND DISCLOSURE
Vegas for Athletes recommends, but does not require, that athletes receive a heart screening prior to participation. As part of the VFA Summer Games, a complimentary ECG heart screening may be offered, subject to scheduling, medical review timelines, and operational capacity.
I understand and agree that ECG screening is voluntary and not required to participate, ECG screening is not diagnostic, ECG screening does not guarantee safety or clearance to play, normal results do not rule out all heart conditions, and abnormal results do not confirm a diagnosis.
3. INFORMED CONSENT TO ECG SCREENING (IF ELECTED)
By signing this waiver, I consent to an ECG screening performed by VFA staff, volunteers, contractors, or medical partners. I acknowledge that screening has inherent limitations, results may be delayed, incomplete, unreadable, or unavailable, human error or technical malfunction may occur, screening does not establish a physician-patient relationship, and follow-up care and medical decisions are my sole responsibility.
I understand that VFA does not provide medical clearance and does not determine fitness to participate.
4. SPORT-RELATED ASSUMPTION OF RISK
I acknowledge and understand that the VFA Summer Games is a multi-sport athletic event that includes, but is not limited to, baseball, basketball, flag football, golf, gymnastics, hockey, pickleball, soccer, softball, swimming, tennis, track and field, taekwondo, volleyball, as well as related training, warm-ups, demonstrations, ceremonies, and event activities.
I understand and voluntarily assume all risks associated with participation in any VFA Summer Games sport or activity, including but not limited to physical contact or collisions with other participants, falls, trips, and impact injuries, head injuries, concussions, or loss of consciousness, strains, sprains, fractures, or overuse injuries, water-related risks associated with swimming, strikes to the head or body in combat sports, injuries caused by equipment, playing surfaces, or weather conditions
I understand that these risks exist regardless of skill level, supervision, or safety precautions.
This waiver applies to all sports, activities, and events offered as part of the VFA Summer Games, whether listed above or added at a later date.
5. ASSUMPTION OF ALL RISKS
I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with athletic participation, event activities and facilities, travel to and from venues, medical screening or lack thereof, and delayed, unavailable, or unreviewed medical results
6. RELEASE AND WAIVER OF LIABILITY
To the maximum extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Vegas For Athletes, its directors, officers, employees, medical advisors, volunteers, sponsors, partners, contractors, venues, and affiliates from any and all claims, including claims arising from negligence, whether active or passive, related to personal injury, illness, cardiac events, permanent disability, death, and property damage.
This release applies to all claims, whether known or unknown, suspected or unsuspected, arising out of participation or screening.
7. INDEMNIFICATION
I agree to indemnify and hold harmless Vegas For Athletes from any claims, damages, losses, legal fees, or costs arising from my or my child’s participation, including claims brought by third parties.
8. MEDICAL AUTHORIZATION
In the event of an emergency, I authorize VFA to obtain medical treatment for myself or my child. I understand that I am financially responsible for all medical care provided.
9. MEDIA RELEASE
I grant Vegas For Athletes permission to use photographs, video, audio, or likeness of myself or my child taken during the event for promotional, educational, or media purposes, without compensation.
10. PRIVACY AND DATA USE
I acknowledge that medical information will be handled in accordance with applicable privacy laws. De-identified data may be used for research or reporting purposes unless revoked in writing.
11. GOVERNING LAW AND SEVERABILITY
This agreement shall be governed by the laws of the State of Nevada. If any portion is deemed unenforceable, the remaining provisions shall remain in full force and effect.
12. ACKNOWLEDGMENT AND AGREEMENT
I certify that I have read and understand this entire document, I am voluntarily giving up legal, rights, and I have authority to sign for myself or my child.
