Informed Consent and Acknowledgement
1. Acknowledgment of Risk
I understand and acknowledge that participation in fitness activities, personal training sessions, classes, and use of the gym facilities at Prolific Training (“The Facility”) carries with it certain inherent risks. These include, but are not limited to, physical exertion, muscle strain, injuries to bones, joints, tendons, ligaments, and other risks associated with exercise and the use of gym equipment. I affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in physical activity.
2. Assumption of Risk and Waiver of Liability
By signing this form, I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury that may be sustained by me as a result of my participation in activities at The Facility, whether caused by the negligence of Prolific Training, its employees, contractors, agents, or otherwise. I hereby waive, release, and discharge Prolific Training, its owners, officers, employees, agents, and representatives from any and all claims, demands, damages, or rights of action arising out of or in connection with my use of the facility or participation in any of its programs.
3. Indemnification
I agree to indemnify and hold harmless Prolific Training from any loss, liability, damage, or cost they may incur due to my presence at The Facility or participation in any activity, whether caused by my own negligence or otherwise.
4. Medical Treatment
In the event of an injury or medical emergency, I authorize Prolific Training to obtain medical treatment for me and release it from all liability resulting from that action. I understand and agree that I am financially responsible for any medical treatment provided.
5. Photo and Video Release
I understand that Prolific Training may take photographs and videos during training sessions and gym activities for promotional purposes. I hereby grant Prolific Training the irrevocable right and permission to use my likeness in such media for advertising, promotional materials, websites, social media, and other commercial purposes, without compensation. I waive any right to inspect or approve the finished product wherein my likeness appears.
6. Entire Agreement
This agreement constitutes the entire agreement between Prolific Training and the participant. No oral representations, statements, or inducements apart from this written agreement have been made.
