1. Scope of Services Cruise Fish Dive (“Service Provider”) agrees to perform underwater recovery, search operations, inspections, or other underwater services (“Services”) as requested by the client (“Client”). All Services will be conducted using professional techniques, proper equipment, and industry‑standard safety practices.2. Best Effort Commitment –Although our success rate is high, locating and recovering items underwater is never guaranteed. No Guarantee of Results. Underwater environments are inherently unpredictable. Visibility, currents, depth, bottom composition, weather, and other factors may limit or prevent successful recovery or completion of the requested task. While every reasonable effort will be made to complete the Services, no guarantee—express or implied—is made regarding the recovery of any item or the achievement of any specific outcome. Payment is for time, expertise, and equipment—not results.3. Safety & Operational Authority. The diver has full authority to modify, delay, or discontinue operations at any time if conditions are deemed unsafe or unsuitable. Safety is the top priority. Decisions made by the diver regarding environmental risks, safety, or operational limitations are final.4. Client Responsibilities. The Client agrees to:Provide accurate information regarding the circumstances, location, and nature of the lost item or requested service. Disclose any known hazards, debris, wildlife concerns, or environmental risks. Understand that inaccurate or incomplete information may reduce the likelihood of success. The Client acknowledges that underwater recovery is a specialized service with inherent uncertainties.)5. Fees, Payment & Non‑Refundable Charges. Service fees are based on time, equipment, travel, and complexity. Fees are due regardless of whether the lost item is recovered. Travel, fuel, boat use, and specialized equipment may incur additional charges. Deposits or payments, when required, are non‑refundable. Extended search time beyond the initial estimate may result in additional charges.6. Liability Limitations. The Service Provider is not liable for:Items that cannot be recovered. Damage to items during recovery attempts. Pre‑existing damage or deterioration. Losses incurred by the Client due to unsuccessful recovery. Environmental conditions that prevent completion of the task. The Client understands that underwater recovery involves risks, including the possibility that the item is unrecoverable, damaged, buried, or moved by tides, storms, or wildlife.7. Florida‑Specific. Acknowledgment Under Florida law, underwater conditions, tides, and submerged hazards can vary significantly and may pose risks to divers and equipment. The Client acknowledges that:Conditions may change rapidly. Wildlife encounters are possible. Storms, tides, and currents may move or bury items beyond recovery. The Service Provider will not violate any Florida wildlife, boating, or environmental regulations during the performance of Services.8. Liability Waiver & Hold Harmless Agreement. By hiring the Service Provider, the Client agrees to release, indemnify, and hold harmless Cruise Fish Dive, its owners, contractors, and divers from any claims, damages, losses, or liabilities arising from: Unsuccessful recovery. Damage to recovered items. Environmental conditions. Delays or cancellations due to safety concerns. Any risks inherent to underwater operations. This waiver applies to all Services performed, whether on private property, public waterways, or coastal areas.9. Property Rights. Any item successfully recovered becomes the sole property of the Client. The Service Provider may document the recovery process for safety, training, or record‑keeping unless the Client requests otherwise in writing.10. Cancellations & Rescheduling. Cancellations made within 72 hours of the scheduled service may incur a fee. Weather or unsafe conditions may require rescheduling. The Service Provider is not responsible for delays caused by weather, tides, or environmental factors.11. Acceptance of Terms. By scheduling or hiring Cruise Fish Dive for underwater recovery or diving services, the Client acknowledges and agrees to these Terms & Conditions, including the understanding that: Every effort will be made to complete the task, but no outcome can be guaranteed.
