  • INTRODUCTION AND PARTIES

    Thank you for selecting Joerika Stitt Esquire, LLC for your prenuptial agreement services. This Limited Scope Engagement Agreement is made and entered into as of the date signed below by and between:

    Client: The individual who has completed the eligibility screener and whose name and contact information appear in the intake form submitted through the My Prenuptial Agreement Navigator™.

    Firm: Joerika Stitt Esquire LLC, 211 W. Wacker Drive, Suite 200B, Chicago, Illinois 60606. Phone: 708-252-3042. Email: office@joerika.com. Principal Attorney: Joerika Stitt, Esq.

  • SCOPE OF SERVICES

    The Firm will provide the following limited scope legal services on a fixed-fee basis.

    Prenuptial Agreement Drafting: Preparation of one initial draft of a prenuptial agreement including Schedule A based exclusively on the information provided through the intake form.

    One Round of Revisions: The Firm will incorporate Client feedback and prepare one final revised draft.

    Attorney Review: A licensed Illinois attorney will review all drafted documents before delivery.

    This is a document drafting and delivery service only. No consultation, negotiation, or court appearance is included unless separately engaged.

  • EXCLUDED SERVICES

    The following are expressly excluded from this Agreement:

    Any services not listed above.

    Consultations beyond what is necessary to complete the draft.

    Direct negotiation with the prospective spouse or their attorney.

    Additional rounds of revisions beyond the one set described above.

    Representation in any court or administrative proceeding.

    Tax, valuation, or financial planning services.

    Services related to assets not disclosed in the intake form.

    Post-signing disputes or enforcement actions.

    Independent legal advice to the prospective spouse.

    Any additional services require a separate written engagement agreement.

  • FEE STRUCTURE AND PAYMENT TERMS

    The Client agrees to pay a fixed fee of $1,850, $2,500, or $3,850 as determined by the eligibility screener. The applicable fee is displayed on the payment page that follows this agreement.

    The fee is due in full before the Client submits the intake form.

    The fee is earned once the Firm begins substantive legal work. If the Client terminates before substantive work begins the Firm will refund the fee in full.

    In accordance with Illinois Rule of Professional Conduct 1.5 the Firm will always refund any portion of a fee determined to be unearned or unreasonable.

    The fee is not contingent on any outcome or on the Client's decision to marry or execute the prenuptial agreement.

  • CLIENT RESPONSIBILITIES

    The Client agrees to:

    Provide complete and accurate information through the intake form including full legal names and all assets and liabilities for both parties.

    Carefully review all draft documents and provide timely feedback.

    Take sole responsibility for the accuracy and completeness of all financial disclosures entered into the intake form.

    Ensure that their prospective spouse obtains independent legal counsel to review the prenuptial agreement before signing.

  • FIRM RESPONSIBILITIES

    The Firm agrees to:

    Provide competent limited scope legal services in accordance with Illinois Rules of Professional Conduct.

    Draft a prenuptial agreement that complies with the Illinois Uniform Premarital Agreement Act, 750 ILCS 10/.

    Maintain confidentiality of all client information consistent with attorney-client privilege.

    Respond to client inquiries within two business days.

    Deliver the completed prenuptial agreement within 24 to 48 business hours of receiving the fully submitted intake form.

  • CONFIDENTIALITY

    All communications between the Client and the Firm are protected by attorney-client privilege from the moment this Agreement is signed.

    The Firm communicates primarily via email. The Client is responsible for keeping their contact information current with the Firm.

  • DOCUMENT RETENTION

    The Firm will deliver the final prenuptial agreement and Schedule A to the Client electronically upon completion.

    The Firm will retain electronic copies of all documents for five years from the conclusion of representation.

    The Client is responsible for safekeeping the original executed prenuptial agreement.

  • TERMINATION

    Either party may terminate this Agreement upon written notice.

    Upon termination the Client remains responsible for the fee to the extent earned based on work performed. If the Firm has been paid more than the value of work reasonably performed it will refund any unearned portion consistent with Illinois Rule of Professional Conduct 1.5.

  • GOVERNING LAW AND DISPUTE RESOLUTION

    This Agreement is governed by the laws of the State of Illinois.

    Any legal action arising from this Agreement shall be brought exclusively in the state courts of Cook County, Illinois.

    The parties agree to attempt cooperative resolution and to participate in non-binding mediation in Cook County before commencing any litigation.

  • CLIENT ACKNOWLEDGMENT

    By signing below the Client confirms that:

    They have read this Agreement in full and understand its terms.

    They have had the opportunity to seek independent legal advice about this Agreement.

    They agree to be bound by its terms.

    They understand this is limited scope representation for document drafting only.

    They understand their prospective spouse must retain independent counsel.

    They understand the fee is earned once substantive work begins.
