Hold Harmless & Assumption of Risk
I am aware that the topics and workshops being presented during the event are meant for the safe, sane, and consensual interaction of adults (regardless of gender or sexual preference) in a sexual and fetish-based exchange. I am not offended by the materials and presentations that refer to the behavior, lifestyles, and objects used in fetish play, nor am I offended by the terms, methods, and objects used to convey such information. I understand and fully agree that any and all activities taking place during the event are intended to be of an educational and/or entertainment nature.
I will not use any information obtained by me during my attendance at the Event and location in a manner that is intended to harm, disparage, defame or slander Wisconsin Alliance of Leather & Kink, Inc., its producers, directors, officers, volunteers, agents, and/or employees or the owners, management and staff of the hosting venues, or any instructors, staff, presenters, sponsors, vendors, individuals, or groups involved or participating in the Event. I am not a member of a religious, political, government, law enforcement or activist group whose purpose is to prevent or oppose the presentation of educational material concerning sexual practices between consenting adults of any particular gender or sexual orientation.
Assumption of Risk. Participant is a voluntary participant in this Event. Participant understands and agrees that neither the Event nor Wisconsin Alliance of Leather & Kink, Inc. can guarantee their safety.
Participant is responsible for researching and evaluating the risks they may face and they are responsible for their own actions. Any activities in which they may take part, whether as a component of the Event or separate from it, have been undertaken with their understanding and acceptance of any and all risks involved, which include but are not limited to physical or psychological injury, pain, suffering, disfigurement, temporary or permanent disability, economic or emotional loss, property loss or damage, loss of income or career opportunities, and/or death. Participant understands that these injuries or outcomes may arise from their own or others’ actions, inaction, or negligence; conditions related to travel; or the condition of the location where the Event is taking place. Nonetheless, Participant assumes all related risks, both known or unknown, whether or not listed above, of their participation in the Event, including travel to, from and during the Event.
Waiver and Release of Claims. In consideration of being accepted into and/or participating in the Event, Participant agrees to and hereby does, for Participant and on behalf of Participant’s heirs, executors, administrators, employers, agents, representatives, insurers, and attorneys, release and discharge Wisconsin Alliance of Leather and Kink Inc., its producers, officers, volunteers, agents, and/or employees of and from any and all claims which may arise from any cause whatsoever, including claims arising from any negligent act or omission by Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees or others. Participant further releases and discharges Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees from liability for any accident, illness, injury, loss or damage to personal property, or any other consequences, arising or resulting directly or indirectly from Participant's participation in the Event.
Indemnification and Hold Harmless. Participant hereby agrees to indemnify, defend, and hold harmless Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees from any and all claims of injury, loss or liability whatsoever including reasonable attorneys’ fees and/or any other associated costs, that may arise as a result of their participation in the Event. If Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees incurs any of these types of expenses, Participant agrees to reimburse Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees.
To the extent Participant engages in activities that are not part of the Event and from which Participant may sustain personal injury or other damage to him/herself or property, or cause others to be injured or sustain other damage including damage to their property, Participant understands that neither Wisconsin Alliance of Leather & Kink, Inc., its producers, officers, volunteers, agents, and/or employees will be held responsible regardless of cause or fault.
Adherence to Standards. Participant understands and agrees to abide by all Wisconsin Alliance of Leather & Kink, Inc. policies, rules, and regulations applicable to the Event. Our communities recognize the phrase “Safe, Sane, Consensual” as the best brief summary of the principles guiding our practices: Safe is being knowledgeable about the techniques and safety concerns involved in what you are doing, and acting in accordance with that knowledge. Sane is knowing the difference between fantasy and reality, and acting in accordance with that knowledge. Consensual: respect the limits imposed by each participant at all times. One of the recognized ways to maintain limits is through a “safeword” which ensures that each participant can end his/her participation with a word or gesture.
You must be at least eighteen years of age the day prior to the event in order to attend. All attendees will be required to show a government ID indicating that they are of legal age in order to enter the event.
You must be dressed appropriately at all times. All attendees must be careful to be dressed appropriately while in the public spaces of the hotel, in the parking lots, and when “leaving” the event to go to local restaurants and shops. Be mindful that the local businesses are NOT a part of the event and that everyday “vanilla” attire and behavior is required. Let’s not be our own worst enemy.
Please refrain from any behavior that interferes with the ability of presenters or contestants to deliver their workshop, speech, fantasy, etc. Please refrain from any behavior that interferes with other persons enjoyment attending this event. If you feel that you are the subject of rude or improper behavior, please notify event or venue staff.
The Rules apply to EVERYONE. Your good behavior will inspire others and your bad behavior may affect us all. Please use common sense in what you wear and how you behave.
Do not touch anyone’s body or equipment without permission. You are not required to say or do anything.
Prostitution, solicitation and negotiation of payment for sexual services are ILLEGAL and will not be tolerated at the event. Violations shall result in permanent removal from the event.
Obey all federal, state and local laws and ordinances.
Severability. It is understood and agreed that, if any provision of this Agreement or the application thereof is held invalid, the invalidity shall not affect other provisions or applications of this Agreement which can be given effect without the invalid provisions or applications. To this end, the provisions of this Agreement are declared severable.
Governing Law and Venue. This agreement shall be construed in accordance with, and governed by, the laws of the State of Wisconsin. The venue for any action arising out of this Agreement shall be Milwaukee County, State of Wisconsin. The parties agree to submit to jurisdiction in the State Courts, Milwaukee County, Wisconsin.
Construction and Scope of Agreement. The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any party. This Agreement is the only, sole, entire, and complete agreement of the parties relating in any way to the subject matter hereof. No statements, promises, or representations have been made by any party to any other, or relied upon, and no consideration has been offered or promised, other than as may be expressly provided herein. This Assumption of Risk, Release of Claims, Indemnification, and Hold Harmless and Agreement supersedes any earlier written or oral understandings or agreements between the parties.
Participant acknowledges that he/she has read this Assumption of Risk, Release of Claims, Indemnification and Hold Harmless Agreement, understands its meaning and effect, and agrees to be bound by its terms.**
