Sponsor Agreement and Release of Liability
Dash For disABILITIES for Special Needs Families
I, the undersigned Sponsor or authorized representative of the sponsoring organization, acknowledge and understand the following:
Rock'n Our Disabilities Foundation does not provide sponsors with medical insurance, liability insurance, or coverage for loss, damage, or injury of any kind. I voluntarily assume all risks associated with sponsorship of and participation in the Dash For disABILITIES for Special Needs Families event, including but not limited to attendance, setup, promotional activities, booth presence (if applicable), and interaction with participants, vendors, volunteers, and the public.
I hereby agree to release, waive, discharge, and hold harmless Rock'n Our Disabilities Foundation, the Town of Apple Valley, and their respective officers, agents, representatives, employees, volunteers, and affiliates from any and all liability, claims, demands, damages, losses, or causes of action arising out of or related to my sponsorship or participation in this event. This release includes, but is not limited to, liability for death, personal injury, illness, property damage, financial loss, or reputational harm, whether caused by the active or passive negligence of the released parties or by any defective or hazardous condition of any property, facility, or equipment owned, operated, or maintained by the released parties.
I further agree that this Agreement and Release of Liability is executed with full knowledge and understanding on behalf of myself and my organization. I certify that all information provided in connection with this sponsorship is true and accurate.
I agree to comply with all event rules, policies, safety guidelines, branding standards, and sponsorship requirements established by Rock'n Our Disabilities Foundation and the Town of Apple Valley.
Indemnification
I agree to indemnify, defend, and hold harmless Rock'n Our Disabilities Foundation and the Town of Apple Valley from and against any and all claims, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising out of or related to my organization’s sponsorship, promotional materials, products, services, representatives, or actions associated with this event.
Photo, Video, and Media Release
I hereby grant permission to Rock'n Our Disabilities Foundation and the Town of Apple Valley to use my name, business name, logo, likeness, voice, and any photographs, video recordings, audio recordings, or other digital media captured in connection with this event for any lawful purpose. This includes, but is not limited to, marketing, promotional materials, social media, websites, printed publications, fundraising materials, and future event promotion, without payment or other consideration.
I understand and agree that all such media becomes the property of Rock'n Our Disabilities Foundation and may be edited, altered, copied, published, or distributed at their discretion. I waive any right to inspect or approve the finished materials and waive any right to royalties or compensation arising from their use.
I hereby release and forever discharge Rock'n Our Disabilities Foundation and the Town of Apple Valley from any claims, demands, or causes of action that I, my organization, heirs, representatives, successors, or assigns may have by reason of this authorization.
Electronic Agreement and Acknowledgment
By signing or submitting this agreement electronically, I acknowledge that I have read, understand, and voluntarily agree to all terms contained in this Sponsor Agreement and Release of Liability. I understand that my electronic signature or acknowledgment constitutes a legally binding agreement, equivalent to a handwritten signature.
