In consideration of being permitted to participate in the above-referenced Poker Run (the “Event”), I, the undersigned participant, hereby agree as follows:
1. Assumption of Risk
I understand that participation in the Event involves inherent risks, including but not limited to: motor vehicle operation, traffic hazards, road conditions, weather, actions of other participants, mechanical failure, and the possibility of serious injury, property damage, or death. I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.
2. Release and Waiver of Liability
I hereby release, waive, and discharge the Mid-Ohio Annual Bikefest, and all affiliated entities, officers, directors, members, volunteers, sponsors, event staff, and property owners (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, or liabilities of any kind arising out of or related to my participation in the Event, including but not limited to claims for personal injury, death, or property damage, to the fullest extent permitted under Ohio law.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, costs, or expenses (including attorney fees) arising from my participation in the Event or my failure to comply with the terms of this Waiver.
4. Compliance with Laws and Rules
I agree to comply with all applicable federal, state, and local laws, including Ohio traffic laws, and any rules or instructions provided by event organizers. I confirm that I possess a valid driver’s license (if operating a vehicle), required insurance, and that my vehicle is in safe operating condition.
5. Medical Treatment
I consent to receive medical treatment deemed necessary in the event of injury or illness during the Event and agree that the Released Parties are not responsible for any medical expenses incurred.
6. Alcohol and Substance Acknowledgment (if applicable)
If alcohol is available or consumed during the Event, I understand that participation while impaired is dangerous and unlawful. I accept full responsibility for my actions and decisions and agree not to operate a vehicle while impaired.
7. Photography and Media Release
I grant permission for the Mid-Ohio Shrine Club to use photographs, video, or other recordings of me taken during the Event for promotional or charitable purposes without compensation.
8. Severability and Governing Law
If any provision of this Waiver is found unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the State of Ohio.
9. Acknowledgment
I acknowledge that I have read this Waiver, fully understand its terms, and sign it voluntarily. I understand that by signing this document, I am giving up substantial legal rights.
