TERMS & CONDITIONS

Reservations will be accepted on a first come, first served basis. Payment must accompany application form. Application will not be accepted without completed application form, signed acknowledgement of terms and conditions, and full payment. All completed application and registration fees must be received by the MARCH 20, 2026 deadline. Any application received after this date is not guaranteed consideration. If desired location is listed above, we will try to accommodate your request, but final location selection will be made by CCC Staff, based on space, size and cooking requirements.The Private Party contact agrees not to sublet space or exhibit/sell props or merchandise without permission from Crescent City Classic. The Private Party understands that exclusivity of companies or groups is not offered. The Private Party understands that this agreement does not authorize the Crescent City Classic to obligate or award future business. Future participation, if any, will be governed under separate agreements. The Private Party agrees that all equipment, products and signage must fit within their tent/designated space, and that storage space is confined to assigned area. Nothing may obstruct the free flow of pedestrian traffic. The Private Party agrees that no out of tent solicitation is permitted and that the playing of loud music or other loud noise is not permitted without advance permission of the Organizer. The Private Party understands that absolutely no food or drink may be sold from tent space without advance permission of the Crescent City Classic and no Private Parties are allowed to bring alcoholic beverages into the Race Fest without prior written approval from The Crescent City Classic. The Private Party agrees that all displays will be fully set up by 7:00 am on Saturday, APRIL 4, unless otherwise pre-approved by the Crescent City Classic. The Private Party agrees to complete tent/displace area breakdown by 2:00 pm on Saturday, APRIL 4. Tent space must be maintained in a clean and orderly manner at all times and be clean and orderly upon departing the Race Fest and City Park. In the event that the facility in which the Race Fest is to be held or is held is destroyed or becomes unavailable for occupancy or Crescent City Classic is unable to permit the Private Party to occupy the facility or the space, or the Race Fest is cancelled or curtailed for any reasons beyond the control of Crescent City Classic, including but not limited to, casualty, explosion, fire, lightening, flood, weather, epidemic, earthquake, or other acts of public enemies, riots or civil disturbances, strike, lockout or boycott, Crescent City Classic will not be responsible for any loss of business, consequential or special damages or expenses of whatever nature that the Private Party may suffer. No refunds will be made to any Private Party who fails to occupy their reserved space. Cancellations must be made at least 30 days prior to Race Day in order to obtain refund of tent fees (does not include site fee, which is non-refundable). The Private Party agrees to obey all laws, by-laws, ordinances, and regulations governing use of the facility and operation of the Race Fest, abide by the rules and regulations of the city, fire and police departments, and any other government or regulatory body having authority to regulate the Vendor area and Race Fest, and obey all laws, including those pertaining to health and safety, consumer protection, and protection of the race participants who attend the CCC Race Fest. The Private Party agrees to abide by all rules and regulations governing the Private Party area established by the Crescent City Classic. The Private Party agrees to obtain, at its own expense, any licenses or permits which are required for the operation of their Tent Area.The Crescent City Classic reserves the right to reject or prohibit Private Parties which the Crescent City Classic considers objectionable, inappropriate, disruptive or offensive to Crescent City Classic, other Festival Vendors, Private Parties or race participants; change or modify the layout of the Private Party’s Area and/or relocate tents of Private Parties; cancel, in whole or in part, the Race or Race Fest due to an event of force majeure or change the date, location and duration of the Race Fest, without any liability to Crescent City Classic. The Crescent City Classic shall have the right to establish and amend or modify any regulations governing use of the facility and the Race Fest.The Private Party will indemnify, defend, and hold harmless the Crescent City Classic, Festival Coordinator, their officers and employees, successors, and assigns from any claims, damages, liabilities, losses, government proceedings, and costs and expenses, including reasonable attorneys’ fees and costs of suit, arising out of any or all aspects of this Agreement and Private Party’s activities hereunder. The Private Party assumes complete responsibility and liability for all injury to any and all persons or property in any way connected with the Private Party’s display caused by the Private Party, his agents, representatives, attendees or employees. PrivateParty shall obtain and maintain at its own expense a comprehensive general liability and all risk property insurance policy. At the request of the Crescent City Classic, the Private Party shall provide Crescent City Classic with a copy of such policy. Neither the Crescent City Classic, Festival Coordinator, nor the facility will assume liability for loss or damage, through any cause, of equipment, products, goods, exhibits, or other materials owned, rented, or leased by the Private Party.
