Port Jervis Soap Box Derby, Inc.  WAIVER/RELEASE

In consideration of being permitted to utilize the Soap Box Derby Race track facilities at Port Jervis, NY and in consideration of the benefits received by me as a result of said use, I, together with my heirs, executors, administrators and assigns, hereby release, waive, and forever discharge and covenant not to sue the Port Jervis Soap Box Derby, Inc., its sponsors, The City of Port Jervis and the International Soap Box Derby Inc., their sponsors, and all their officers, agents, members, employees, full or part-time insurers, lessees, lessors, board members, committee members, volunteers and associates of any status whatsoever, all for the purpose herein referred to as Releasees, from all liability to me, my heirs, executors, administrators and assigns for all loss or damage, and any claim or damage therefore, on account of injury to my person or property or resulting in my death, whether caused by the negligence of Releasees or otherwise while I am utilizing the above-described race track facilities and/or observing any Soap Box Derby and/or related event being held in the City of Port Jervis, New York.

I hereby further agree to indemnify and to hold forever harmless the said Releasees from any and all claims, loss liability, damage or cost releases may incur due to my presence in the City of Port Jervis while utilizing the above-described race track facilities and /or participating in and/or observing Soap Box Derby races and/or events.

I expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect.

I,being of lawful age, in consideration of being permitted to utilize the above-described race track facilities and/or participate in and/or observe Soap Box Derby races and/or events in the City of Port Jervis release and forever discharge Releasees, their heirs, administrators and executors of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death, and/or property damage which may occur as a result of my utilization of the above-described race track facilities and/or any participation in and/or observation of Soap Box Derby races and/or events in the City of Port Jervis or any activity in connection therewith, whether by negligence or not.

Port Jervis Soap Box Derby Driver Acknowledgment:

Driver of a Soap Box Derby racer entered in the Port Jervis Soap Box Derby hereby certify that I have built my racer in full compliance with the rules and regulations adopted by the Committee of the Port Jervis Soap Box Derby, Inc.

Parental Acknowledgment:

 I  agree to let our Son/daughter to enter in the City of Port Jervis Soap Box Derby.

·         I/We acknowledge that the Port Jervis Soap Box Derby, Inc, its agent and/or subsidiaries are not to be held liable for any accidents involving our child in which our child has used a soap box derby car in any non-authorized manner.

·         I/We fully understand and have signed the Parental Permission and Release of Liability Waiver.

·         I/We fully understand that this year’s race is a sanctioned race and that the winner will be chosen through the process of elimination.

Akron Local Race Registration Form:

As a racer of a Soap Box Derby car entered in the official Soap Box Derby Local Race being held In Port Jervis, hereby certify that my car has been built in full compliance with the most current construction plans and rules published by the International Soap Box Derby, Inc.

As a (parent/guardian), hereby certify that my son/daughter/ward, entrant in the official Soap Box Derby Local Race being held in Port Jervis, has read the above statement completed by my son/daughter/ward and know the facts stated therein to be true. Further, I hereby grant permission for my son/daughter/ward to enter the official Soap Box Derby Local Race in Port Jervis and in the event he or she is adjudged the winner of the official Soap Box Derby Local Race, to participate in the FirstEnergy All-AmericanSoap Box Derby World Championship in the current race year in Akron, Ohio.

Further, I understand and agree that, as a prerequisite to competing in the FirstEnergy All-American Soap Box Derby in Akron, Ohio, that my
son/daughter/ward, together with his/her car, shall have undergone and passed an inspection conducted in Akron, Ohio by the International Soap
Box Derby, Inc. I further understand and agree that such inspection shall be conducted using the manner and methods deemed appropriate by the
International Soap Box Derby, Inc., in its sole discretion, to determine compliance with its rules, spirit and specifications applicable to that division
and that the decisions of the International Soap Box Derby, Inc. and its officials regarding qualification, disqualification and compliance with the
rules, spirit and specification applicable to that division shall be final and binding upon me, my son/daughter/ward and all other parties.

Photographic Release. I grant and convey to the Derby all rights, title, and interests in any and all photographs, images, video, or audio
recordings of me or my likeness made by Derby or its agents in connection with my providing volunteer services to the Derby. 

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I (parent/guardian, and/or my
son/daughter/ward) may be exposed to or infected by COVID-19 by attending an event that such exposure or infection may result in personal
injury, illness, permanent disability, and death. understand and agree that this release includes any claims based on the actions, omissions, or
negligence of the ISBD, its employees, volunteers, participants or others, whether a COVID-19 infection occurs before, during or after participation
in any ISBD sanctioned event.

Event guidelines is subject to change based on state and local guidelines.

Finally, I, as such parent or guardian, in consideration of the benefits received as a result of the participation herein, and for the mutual benefits
received by myself and my child and the other participants herein, hereby waive and release any and all claims, rights, causes of action, demands or
otherwise, whether for personal injuries, property damage, or any other loss, damages or expenses which I, as a parent/guardian, and/or my
son/daughter/ward may have against the Local Soap Box Derby, its sponsor, the International Soap Box Derby, Inc., and/or its sponsors, agents,
employees, full or part-time, or associates of any status whatsoever, arising from or in any manner related to my son's, daughter's or ward's participation in the Local Soap Box Derby, the FirstEnergy All-American Soap Box Derby and/or any activities incidental or related thereto.

Parent/Guardian Code Of Conduct

The International Soap Box Derby, Inc. has implemented the following Parent/Guardian Code of Conduct for the important message it holds about the proper role of parents in supporting their child in racing. Parents MUST read,
understand and sign this form prior to their children participating in our races.
I understand that any action inconsistent with this Code of Conduct or any failure to take action mandated by this Code of Conduct may result in my immediate removal from the facility. I also understand that I may be suspended from following
events pending a review by the Conduct Committee of the ISBD. Repeat violations may cause forfeiture of the privilege of attending all events. I acknowledge and agree that the Derby has the complete and absolute discretion to make a determination as to this issue and its decision shall be final and binding. I therefore agree:

1. I will not force my child to participate in Soap Box Derby racing.

2. I will remember that children participate to have fun and that the activity is for youth, not adults.

3. I will inform the Race Director of any physical disability or ailment that may affect the safety of my child or the safety of others.

4. I will learn the rules and policies of the organization.

5. I (and my guests) will be a positive role model for my child and encourage sportsmanship by showing respect and courtesy, and by demonstrating positive support for participants, officials and spectators at every race or any related event.

6. I (and my guests) will not engage in any kind of unsportsmanlike conduct with any official, racer, or parent such as booing and taunting; refusing to shake hands; or
using profane language or gestures.

7. I will not encourage any behaviors or practices that would endanger the health and well being of the participants, officials and spectators.

8. I will teach my child to play by the rules and to resolve conflicts without resorting to hostility or violence.

9. I will demand that my child treat other participants, officials and spectators with respect regardless of race, creed, color, sex or ability.

10. I will teach my child that doing one’s best is more important than winning, so that my child will never feel defeated by the outcome of a race or his/her performance.

11. I will praise my child for competing fairly and trying hard, and make my child feel like a winner every time.

12. I will never ridicule or yell at my child or other participants for making a mistake or losing a competition.

13. I will emphasize skill development and practices and how they benefit my child over winning. I will also de-emphasize races and competition in the lower age groups.

14. I will promote the emotional and physical wellbeing of the racers ahead of any personal desire I may have for my child to win.

15. I will respect the officials and their authority during races and will never question, discuss, or confront others at the race track, and will take time to speak with officials at an agreed upon time and place.

16. I will demand an environment for my child that is free from drugs, tobacco, and alcohol and I will refrain from their use at all events.

17. I acknowledge and agree that any decisions of the officials of the Soap Box Derby shall be final and binding upon me and my child in all respects and at all times.

PHOTOGRAPHY RELEASE FORM
I hereby consent that any and all videotapes, films, photographs and/ or motion pictures made, and/or audio recordings made of my voice relative to the Port Jervis Soapbox Derby in Port Jervis, NY, may be used by the Port Jervis Soapbox Derby its agents, assignees, licensees, or successors, in whatever way they may desire, including for television programs. Furthermore, I hereby agree that any such
photographs, films, videotapes, and other recordings, shall at all times be the property of the Port Jervis Soapbox Derby.

Port Jervis Soapbox Derby, shall have all right, title and interest to sell, duplicate, reproduce or make other uses of such photographs, films and other recordings, as it may desire, free and clear of any claim whatsoever on my part. I further hereby release, discharge and agree to hold harmless the Port Jervis Soapbox Derby, and its agents, successors, licensees and assignees from all claims and demands whatsoever which I may have arising out of or in connection with the foregoing and waive any right to inspect or approve the same. I hereby certify that I am the parent or legal guardian of the above mentioned (Participant) and hereby also consent on behalf of said minor to the creation and use of the creation and use of the photographs, films or recordings contemplated including without limitation, the release and hold harmless provisions.

Volunteer understands that the scope of Volunteer’s relationship with the Derby is limited to a volunteer position and that no compensation is expected in return for services provided by Volunteer, and that Volunteer is responsible for his/her insurance coverage in the event of personal injury or illness because of Volunteer’s services to the Derby.
1.Waiver and Release. I, the Volunteer, release and forever discharge and hold harmless the Derby, its directors,officers, employees, agents, insurers, successors and assigns from any and all liability, claims, and demands ofwhatsoever kind or nature which arise from my service to or activities with the Derby. I understand andacknowledge that this Release discharges the Derby from any liability or claim that I may have against theDerby with respect to bodily injury, personal injury, illness, death, or property damage that may result, arisefrom, or occur while I am providing volunteer services to the Derby.
2.Insurance. Further, I understand that the Derby does not assume any responsibility for or obligation to provide me with financial or other assistance, including, but not limited to, medical, health, or disability benefits orinsurance of any kind in the event of my injury, illness, death, or damage to my property. I expressly waive anysuch claim for compensation or liability against the Derby beyond what may be offered freely by the Derby.
3.Assumption of Risk. I understand that the services I provide to the Derby may include activities that arehazardous to me including, but not limited to, being around or near gravity-powered cars being driven byyouth. As a volunteer, I hereby expressly assume the risk of injury or harm from these activities and release theDerby from all things occurring while I am providing volunteer services.
4.Photographic Release. I grant and convey to the Derby all rights, title, and interests in any and all photographs,images, video, or audio recordings of me or my likeness made by Derby or its agents in connection with myproviding volunteer services to the Derby.
5.Other. As a volunteer, I expressly agree that this Release is intended to be as broad an inclusive as permittedby the laws of the State of Ohio. I further agree that in the event that any clause or provision of this Release isdeemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
