ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

 

Limelight Dance Center LLC (herein referred to as Limelight), welcomes you to its studio. As a student or participant you are assuming all risks of participating in such activity or event. Please read the following waiver carefully and fully before signing. Should you have any questions or difficulty reading this document please contact us. By signing this document you agree you have read it in its entirety and fully agree.

I, the adult listed, am at least 18 years of age and agree and understand that dance and activities at Limelight have inherent risks and participation in these activities and use of the studio/equipment may result in serious injury. I assume these risks and release Limelight and its agents from all claims; damages; injuries; expenses or death. 

I, on my own behalf, and on behalf of my minor children, (collectively herein referred to as “I”) knowingly, voluntarily and freely accept and assume any and all risk both known and unknown of injuries or other loss or damage suffered while on Limelight premises or at Limelight events held elsewhere. I assume all risks of participation in the activity or event including but not limited to negligence by Limelight employees and/or agents; defective equipment/property; negligent supervision; negligent instruction. 

I am physically able to participate and have not been advised by a medical professional to not participate in physical activities like those held by Limelight. There are no health related reasons or problems that preclude me from safely participating in any activity or event at Limelight. I am in good health and pose no health risk to others by participating. 

I am responsible for the safety and well being of all my minor children that accompany me to Limelight and/or participate. No child will be left unattended at any time or place in Limelight. Any injuries incurred by my children or myself are not the responsibility of Limelight. I will be responsible for the financial cost of anything my child or I break while at Limelight. 

 

I am responsible for minor children in all public spaces including waiting rooms, bathrooms, hallways, parking lots, etc. I am responsible for any injury sustained in the parking lot of Limelight. No minor children should be traversing the parking lot without an adult present. No children are allowed to play in the parking lot of Limelight. Refusal to adhere to this policy may result in your removal. 

I understand all children aged twelve (12) and under will be picked up and dropped off with a “door to door policy”. I will bring my child into Limelight before all classes and pick my child up after all classes.  

 I acknowledge I must be present and ready for my child Five (5) minutes before the class/program ends and in the studio.

Limelight does not allow parents/guardians/unaccompanied minors in its building during classes/programming. No students are allowed in Limelight space unless participating in the classes/programs. After classes/programs are released, students are not permitted to remain at Limelight. One (1) parent must remain at Limelight for Limelight Combo Class. 

 

I acknowledge that travel may be required in conjunction with activities and events for/at Limelight. I agree that Limelight will not be responsible for any injury as the result of said travel. I waive, release and discharge Limelight from all liabilities related to my travel. 

If I sustain an injury, in or out of Limelight, I am required to obtain a doctor's note to return to Limelight and participate. I may be allowed to sit and watch classes and choreography with an injury but not participate. I may be mandated to watch choreography in certain circumstances while injured. I acknowledge that all injuries/illnesses lasting over (2) weeks will require a doctor’s note if my child can not attend classes or sit in to watch classes for any extended time period.

I understand that Limelight is a Massachusetts company. Massachusetts is subject to numerous weather types, including but not limited to Snow; Ice; Rain; Sleet; Hail; Wind. I am assuming the risk of traveling to and from Limelight in all weather conditions. I acknowledge I am assuming the risk of traveling in all parking lot spaces and stairways that are on the exterior to the Limelight building. 

I waive, release and discharge Limelight from any sickness; pandemics; accidents; natural disasters and/or acts of God incurred during participation in activities or events at Limelight.

I have provided information regarding any allergies my child has. I acknowledge that Limelight will not administer or supply any type of medication. Food may occasionally be provided at Limelight events or facilities. Limelight staff is not responsible for monitoring what my child consumes and/or if it is allergy friendly. I acknowledge the Limelight employees do not possess any medical training and will not be able to aid my child with any medical issues including but not limited to allergies.  Parents of children needing medication must remain in the parking lot for the entirety of their child's dance instruction. 

Limelight is not responsible for any lost; stolen or misplaced items. 

Limelight may occasionally use flashing/strobing lights, as well as elevated music levels.  I understand that in order to participate at Limelight I must be in good physical and mental health including but not limited to sensitivity to lights or noise in any fashion. I am assuming all risks associated with strobing/flashing/fluorescent lighting /elevated noise levels and agree not to participate if I am in danger of injury resulting from these lights or noises. 

I agree to indemnify, defend, and hold harmless Limelight or its agents including any loss, cost, or damage of any kind including, but not limited to, attorneys fees; lawsuits or demands resulting from any loss, injury damage or death as well as property damage arising out of or in connection or relation to and activities at Limelight and/or while on the presence of the property. 

I agree that Massachusetts will be the choice of venue for any legal proceedings involving Limelight. 

Severability: I agree that if any part of this agreement is determined to be unenforceable, all other parts shall remain fully in effect. 

I certify I have read this document and fully understand its contents. I am aware this is a release of liability and a contract and I am signing it of my own free will. By signing this document I am releasing Limelight from all liability to the fullest extent of the law. I am mentally capable of making the informed decision to sign this contract. 

I hereby, for myself and my minor children/wards; waive all liability for myself; my heirs; executors; administrators; assigns and personal representatives knowingly and voluntarily. 

RELEASE OF LIABILITY FORM

 

ACDD Pulaski LLC (herein referred to as ACDD), is  the legal owner of the property located at 56 Pulaski Street, Ware MA, 01082. Please read the following waiver carefully and fully before signing. By signing this document you agree you have read it in its entirety and fully agree.

I, the adult listed, am at least 18 years of age.

I, on my own behalf, and on behalf of my minor children, (collectively herein referred to as “I”) knowingly, voluntarily and freely accept and assume any and all risk both known and unknown of injuries or other loss or damage suffered while on ACDD premises. I assume all risks of participation in activities or events on the premises of ACDD including but not limited to negligence by ACDD employees and/or agents; defective equipment/property; negligent maintenance; negligent supervision; negligent instruction. 

I am responsible for the safety and well being of all my minor children that accompany me to ACDD premises. No child will be left unattended at any time or place in ACDD. Any injuries incurred by my children or myself are not the responsibility of ACDD. I will be responsible for the financial cost of anything my child or I break or destroy while on ACDD property. 

I am responsible for my minor children in all spaces including but not limited to waiting rooms, bathrooms, hallways, stairwells, studios, parking lots, etc. I am responsible for any injury sustained in the parking lot of ACDD. No minor children should be traversing the parking lot without an adult present. No children are allowed to play in the parking lot of ACDD. 

 

I waive, release and discharge ACDD from all liabilities related to my travel to and from its premises. 

I understand that ACDD is a Massachusetts company with a Massachusetts property. Massachusetts is subject to numerous weather types, including but not limited to Snow; Ice; Rain; Sleet; Hail; Wind. I am assuming the risk of traveling to and from ACDD property in all weather conditions. I acknowledge I am assuming the risk of traveling in all parking lot spaces and stairways that are on the exterior to the ACDD building. 

I will not hold ACDD liable for any damage/theft.vandalism to my vehicle while parked at ACDD. I acknowledge that my vehicle should be locked at all times while in the parking lot of ACDD. ACDD is not responsible for theft or damage to any means of transportation brought onto the premises including, but not limited to, scooters, bicycles, skateboards, dirtbikes, ATVs, Segways, rollerblades, roller skates. 

I agree to drive in a safe manner on ACDD property, this includes a speed limit not to exceed 5 miles per hour. 

I agree that my minor children will not drive any vehicles without a valid driver's license on ACDD property. 

I waive, release and discharge ACDD from any sickness; pandemics; accidents; natural disasters and/or acts of God occuring on ACDD property.

By submitting payment, I acknowledge and agree that my payment is required to complete registration for the Limelight Dance Center Summer Camp. I understand and accept that all payments are non-refundable, without exception. I further acknowledge that if the participant does not attend the camp for any reason, the full payment will be forfeited.
