E-Line Softball Training: Waiver of Liability and Media Consent

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN: READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF E-LINE SOFTBALL TRAINING USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM E-LINE SOFTBALL TRAINING IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND E-LINE SOFTBALL TRAINING HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

Waiver of Liability and Release: In consideration of being permitted to participate in E-Line Softball Training, I, the undersigned, represent that I am the Natural Guardian (parent or legal guardian) of the participant. I hereby assume all risks of personal injury, including death, and property damage that may result from program activities. I am fully aware of the inherent risks of softball, including but not limited to, being struck by balls, bats, or other equipment; collisions with other participants or structures; and injuries resulting from explosive movements, sliding, or training drills.
The undersigned, on behalf of the registrant, does hereby release, waive, and forever discharge E-Line Softball Training, its owners, employees, trainers, and agents from any and all liability, claims, or causes of action arising out of ordinary negligence, including but not limited to, any failure of equipment, defects in the premises, or negligent instruction or supervision. This release is intended to be as broad and inclusive as permitted by the laws of the State of Florida.

Transportation and Supervision: I acknowledge that E-Line Softball Training’s responsibility for the supervision of the participant begins only when the participant enters the designated training area and ends immediately upon the participant’s exit from the training area. I assume all risks associated with the participant’s transportation to and from the facility, including instances where the minor participant may be driving themselves.

Medical Warranty and Emergency Care: I warrant that the participant is in good health and able to participate in rigorous physical activity. I agree to notify E-Line Softball Training of any medical, physical, or emotional conditions that may limit safe participation. I authorize E-Line Softball Training staff to provide or seek emergency medical treatment as deemed necessary. I agree to assume all costs associated with such emergency care and to indemnify E-Line Softball Training for any such expenses.

Media Consent and Privacy: I grant E-Line Softball Training permission to take photographs and/or video of the participant during training. I assign all rights, including copyright, to E-Line Softball Training for use in marketing, social media, and educational materials. E-Line Softball Training agrees that it will not publish the participant's home address or private contact information in conjunction with such media.

I HAVE READ THIS ENTIRE AGREEMENT. I UNDERSTAND THAT BY SIGNING (OR CHECKING THE CONSENT BOX), I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.
