Waiver
In consideration of being permitted to participate in any way in the Pickleball League (“the League”) at Active Generations, I, for myself, my heirs, or assigns, do hereby release, waive, discharge, and covenant not to sue Active Generations, its officers, employees, volunteers, and agents from liability for any and all claims resulting in personal injuries, accidents, illnesses (including death), and property loss arising from my participation in the League.
Assumption of Risk
Participation in the League carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary but include:
- Minor injuries such as bruises, sprains, and dehydration;
- Major injuries such as eye injuries, joint, bone, or back injuries, heat stroke, heart attacks, and concussions; and
- Catastrophic injuries such as paralysis and death.
I have read and understand these and other risks that are inherent in playing pickleball. I affirm that my participation is voluntary and that I knowingly assume all such risks.
Indemnification and Hold Harmless
I agree to indemnify and hold Active Generations harmless from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the League.
Use Permission
I give Active Generations and its agents or designees permission to use or distribute my image, name, voice, and words for promotional purposes, including but not limited to use on Active Generations’ website and marketing materials.
By signing below, I acknowledge that I have read, understand, and agree to the terms of this Waiver and Release Agreement.
