MANDATORY WAIVERS

PARENT, GUARDIAN, GUEST, PARTICIPANT, SPECTATOR

RELEASE OF LIABILITY & WAIVER OF CLAIMS AGREEMENT

In consideration of you, or your children or those in your custody being allowed access to, or, to use the & Capelli Complex Monmouth ("The Facility"), or, to spectate or participate in any programs, rentals, classes, clinics, or any events at the facility, you do, on behalf off yourself, your heirs, children, and assigns, jointly and severally referred to hereafter as "Participant", to the fullest extent permitted by law, agree as follows:

1) TO WAIVE ALL CLAIMS that you or the participant have or may have against the facility, its owners, staff, employees, directors, or officers, arising out of the participants visit to the facility or participation in the programs or the use of any equipment provided by the facility or by any other person for any other reason whatsoever including but not limited to injury, death, illness, contracting a sickness or virus, including but not limited to the flu or covid 19, or any variant thereof. The participant and his/her parents or legal guardians(s) specifically understand that they are releasing any and all claims that arise or may arise from any negligent acts or conduct of the facility, its owners, affiliates, operators, employees, agents, and officers, to the fullest extent permitted by law.

2) TO ASSUME ALL RISKS of entering the facility, participating in the programs and using the equipment, even those cause by the negligent acts or conduct of the facility, its owners, affiliates, operators, employees, agents, and officers. The participant and his/her parents or legal guardian(s) undersyand that there are inherent risks of entering the facility, being in close proximity to other persons, participating in the various possible programs and using any equipment, as well as navigating the facility, risks which may be both forseen and unforseen and including serious physical injury and death, and including but not limited to illness, contracting as sickness or virus; You also understand and accept the risks of, and waive all claims in the event you, your child, minor, or guests are exposed to any infections, illnesses, viruses, or other contagions including but not limited to various forms of the flu or Covid 19. You are agreeing that you will not enter the facility or engage in any activities at the facility if you are feeling ill, have a fever, or exhibit any other Covid 19 symptoms or if you otherwise feel it might be inappropriate to enter the facility.

3) TO RELEASE the Facility, its owners, affiliates, operators, employees, agents, and officers from all liability for any loss, damage, injury, death, or expense that the participant (or his/her next of kin) may suffer, arising out of his/her participation in the programs and use of the equipment; and

The participant and the participants guardians or custodians, if a minor, understand that visiting and participating in the programs is voluntary and further understands that he/she has the opportunity to inspect the facility before any participation. The participant understands that he/she is obligated to follow the rules of the facility and programs, and that he or she can minimize his/her risk of injury through exercise of common sense and by being aware of his/her surroundings.

If, while participating in the programs, you or the participant observe any unusual hazard, which you/he/she believes jeopardizes your personal safety or that of others, you or the participant will remove yourselves from participation in the programs and immediately bring said hazard to the attention of the facility. A refund for the session will be provided to the participant after advising the facility of the issue. I do hereby authorize Capelli Complex Monmouth LLC and its assigns to utilize any and all photographs, pictures, and other likeness of me or anyone assigned guardianship to me, as they deem apropriate in its promotional materials, or team films. 

To the extent that any portion of this agreement is deemed to be invalid under the law of the applicable jurisdiction, the remaining portions of the agreement shall remain binding and available for use by the facility and its counsel in any proceeding. 

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE. 

MEDICAL WAIVER

General Liability Waiver

I/We the parent(s) or legal guardian(s) of the above named candidate for a position on a Flag Football team, know that participation in flag football may result in serious injuries and protective equipment does not prevent all injuries to players, and do hereby waive, release, absolve, indemnify and agree to hold harmless Island Elite Sports (IES), the organizers, sponsors, participants and parents transporting my/our child to and from activities for any claims arising out of any injury to my/our child whether the result of negligence or for any other cause, except to the extent and in the amount covered by accident or liability insurance. My son/daughter has received a physical examination by a physician and has been found physically capable of participating on a flag football team. I/We hereby give consent to have IES administer basic first aid and an athletic trainer and/or doctor of medicine or dentistry provide my child with medical assistance and/or treatment and agree to be financially responsible for the cost of such assistance and/or treatment.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of participating in Island Elite Sports League, related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1.   Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,

2.   I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

3.   I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

4.   I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (Island Elite Sports) their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

ZERO TOLERANCE POLICY

The following sets forth the specific league policy, rules, and requirements governing behavior of adults and children present at Island Elite Sports playing fields at any time and at all IES games at home and away fields: Island Elite Sports has Zero Tolerance for un-sportsmanlike or unacceptable behavior by coaches, players, parents, fans, spectators, and referees. All adults present will be accountable for their behavior and the behavior of their guests. Parents and guardians will be accountable for the behavior of their children. This document will be used to certify that adults, parents, and guardians understand their responsibilities dictated by this policy. Failure to comply may result in the immediate expulsion from the complex of the offending individual and suspension or expulsion from the league. If expelled, the individual may not return to the compelled pending action by the IES Board of Directors. 

1. Consumption or possession of alcoholic beverages or controlled substances is forbidden at games and practices. 

2. Persons under the influence of alcohol or controlled substances are prohibited from games and practices. 

3. Firearms and weapons are prohibited, except in the possession of law enforcement personnel. 

4. Positive cheering and words of encouragement are acceptable; jeering, booing, hissing, taunting, or any other form of negative fan interaction is prohibited. 

5. Use of profane language is forbidden. 

6. Verbal abuse in any form of umpires, league officials, coaches, players, or spectators and team representatives is prohibited. 

7. Cooperation with umpires, league officials, coaches, and team representatives is expected. 

8. Respect for and adherence to all league rules, policies, and guidelines is expected. 

9. Adults are expected to role-model sportsmanship at all times, regardless of any perceived lack of sportsmanship exhibited by anyone else. 

I hereby certify that I have read and understood the Zero Tolerance Policy of the Island Elite Sports League  and will adhere to the intent and spirit of this Policy.

PHOTO RELEASE

I hereby consent to, and authorize the use and reproduction of, any and all photographs or videos taken of me or my child. This consent allows our images to be used in printed publications, video programs and on our league website and social media pages without compensation to us. All negatives and positives, together with prints, electronic files and videos shall constitute the league's property, solely and completely.

NO REFUND POLICY

All sales and registration fees are final. Island Elite Sports / NCFFL maintains a strict no refund policy for all events, programs, and purchases, including but not limited to tournament registrations, merchandise, and sponsorship packages.

Once payment has been submitted, no refunds, transfers, or credits will be issued for any reason, including but not limited to:

• Scheduling conflicts
• Weather conditions
• Team withdrawal or disqualification
• Player injury or illness
• Travel or accommodation issues 

In the event of a postponement or rescheduling, all registrations will automatically transfer to the new date. If an event is canceled outright by Island Elite Sports / NCFFL and not rescheduled, a credit may be issued at the organization’s discretion toward a future event.

By completing your registration or purchase, you acknowledge and agree to this No Refund Policy and understand that all payments are non-refundable and non-transferable.
