EXPRESS ASSUMPTION OF RISK, RELEASE, INDEMNIFICATION AND COVENANT NOT TO SUE
I, the undersigned, am the parent/guardian of the minor child listed below (“Participant”), who intends to participate in one or more camp programs organized and operated by Envision Charlotte, a North Carolina non-profit corporation (the “Programs”).
In consideration for the services of Envision Charlotte, its officers, directors, employees, agents,representatives, and volunteers, I agree on behalf of myself, and as the parent or guardian of Participant, and on behalf of our heirs as follows:
I understand and am aware that the Programs take place at Envision Charlotte’s Innovation Barn (the“Innovation Barn”), which is working space where individuals and businesses perform activities relating to recycling, composting, and a circular economy.
I also understand and am aware that certain activities at the Innovation Barn may be hazardous or involve inherent or other risks of property damage, bodily injury, anddeath, including the operation of heavy equipment, the ingress and egress of trucks and other vehicles, glass crushing, plastic shredding, and bees.
I further understand and am aware that there is a risk of property damage, bodily injury, and death when participating in or observing such activities, and I have made a voluntary choice for myself and Participant to accept and assume all such risks of property damage, injury, and death that might be associated with or result from participation in the Program.
TO THE FULLEST EXTENT ALLOWED BY LAW, I AGREE TO RELEASE FROM LIABILITY, AND TO INDEMNIFY AND HOLD HARMLESS ENVISION CHARLOTTE (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND VOLUNTEERS) FROM ANY AND ALL LIABILITY ON ACCOUNT OF, OR IN ANY WAY RESULTING FROM, PERSONAL INJURIES, LOSSES, DEATH, AND
PROPERTY DAMAGE, EVEN IF CAUSED BY NEGLIGENCE, IN ANY WAY CONNECTED WITH THE INNOVATION BARN, THE PROGRAMS, AND ANY OTHER ACT OR OMISSION BY OR ON BEHALF OF ENVISION CHARLOTTE. I FURTHER AGREE NOT TO MAKE A CLAIM OR SUE FOR INJURIES, LOSSES OR DAMAGES RELATING TO THE PROGRAMS OR PARTICIPANT’S PARTICIPATION IN THE SAME, EVEN IF CAUSED BY NEGLIGENCE.
I UNDERSTAND AND AGREE THAT THIS AGREEMENT IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY LAW, AND IF ANY PORTION IS HELD INVALID, THE BALANCE SHALL CONTINUE IN FULL LEGAL FORCE. I AGREE THAT NO ORAL
REPRESENTATIONS, STATEMENTS OR INDUCEMENTS APART FROM THIS AGREEMENT HAVE BEEN MADE.
AUTHORIZATION FOR FIRST AID AND MEDICAL TREATMENT
In the event of an emergency or other acute event where time will not allow me to be reached (or I cannot be reached), I authorize Envision Charlotte to call for medical or dental care for Participant if, in the opinion of Envision Charlotte, medical or dental care is needed in connection with any injury suffered by Participant during the Program. In addition, I hereby authorize and consent to any examination, anesthesia, surgery, or other medical/dental procedure or treatment rendered as a result of Envision Charlotte seeking such care.
I AGREE TO PAY FOR ALL EXPENSES AND COSTS ASSOCIATED WITH SUCH CARE AND RELATED TRANSPORTATION.
It is understood that this authorization is given in advance of any specific diagnosis,
treatment or hospital care being required and is given to provide authority and power for a physician to render such care that (in the exercise of their best judgment) they may deem advisable.
PUBLICITY RELEASE
I understand that in connection with Participant’s participation in the Programs, Envision Charlotte may from time to time capture (or have third parties capture on its behalf) photographs and video of Participant.
I acknowledge and agree that Envision Charlotte may use these photographs and video (including Participant’s likeness reflected therein), in any form and medium, in connection with the promotion of Envision Charlotte, the Innovation Barn, and the Programs (including on websites, in press releases, and in other marketing and
promotional materials) without any attribution or compensation to me or Participant.
I HEREBY ACKNOWLEDGE THAT ALL THE INFORMATION I HAVE PROVIDED IN THIS AGREEMENT IS TRUE, CORRECT AND COMPLETE. I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ, UNDERSTOOD AND ACCEPTED EACH OF THE ABOVE PROVISIONS AND THAT THESE PROVISIONS FORM A BINDING AGREEMENT BETWEEN ME AND ENVISION CHARLOTTE, TO WHICH I HAVE VOLUNTARILY SIGNED.
