Despers USA Adult Steelpan Class Liability Policy
Purpose:
This policy is intended to outline the responsibilities of participants and to limit the liability of Despers USA Youth and Culture Association (“Despers USA”) in connection with its adult steelpan classes.
1. Assumption of Risk
By enrolling in and attending Despers USA adult classes, participants acknowledge and voluntarily accept that:
Participation in any group activity carries inherent risks, including but not limited to physical strain, minor injury, or unforeseen accidents.
Despers USA cannot guarantee the personal safety of participants, and each participant assumes full responsibility for their own well-being.
2. Waiver and Release of Liability
Participants agree to release, waive, and discharge Despers USA, its directors, officers, instructors, volunteers, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to participation in adult classes, including but not limited to injury, property damage, or loss.
3. Medical Treatment
Participants are responsible for managing their own health and medical conditions.
In the event of a medical emergency, Despers USA staff may contact emergency medical services. Participants agree to assume all costs of medical treatment.
4. Personal Property
Despers USA is not responsible for the loss, theft, or damage of personal property brought to classes, rehearsals, or events. Participants are encouraged to secure their belongings.
5. Equipment Use & Care
Instruments, stands, and all Despers USA equipment remain the property of the organization and must be handled with care.
Participants are expected to use only the equipment assigned to them and follow all instructions provided by instructors.
Any intentional misuse, neglect, or damage caused by a participant may result in financial responsibility for repairs or replacement, and may lead to dismissal from the program without refund.
Personal instruments may be used with prior approval, but Despers USA assumes no liability for loss or damage to privately-owned instruments.
6. Code of Conduct
To ensure a safe and respectful learning environment:
Participants must follow the instructions of instructors and staff.
Any disruptive, unsafe, or disrespectful behavior may result in dismissal from the class without refund.
Participants agree to respect fellow classmates and maintain a positive, cooperative atmosphere.
7. Photography and Media Release
Unless otherwise stated in writing, participants consent to Despers USA’s use of photographs, video, or audio recordings taken during classes for promotional, educational, and archival purposes.
8. Agreement by Registration and Payment
By completing registration and submitting payment, participants confirm that they:
Have read and understood this Liability Policy;
Are at least 18 years of age;
Voluntarily agree to comply with all terms and conditions outlined above.
Payment for the class serves as acknowledgment and acceptance of this Liability Policy in full, including equipment use and care responsibilities.
