Engagement Confirmation (Limited Scope & Fees)

Scope. Representation is limited to the specific service purchased for one trademark in one class (search, filing preparation/submission, and/or monitoring, as applicable). Not included unless separately retained: Substantive office Action responses, appeals, oppositions, cancellations, specimen creation, foreign filings, post-registration maintenance, etc.
Per-class pricing. All package prices and USPTO government fees are based on one class only. Adding classes increases both legal fees and government fees per class.
When “work begins.”
- Search work begins when you submit (1) your mark (word or logo) and (2) a short goods/services description sufficient to identify likely classes. At that point a $249 minimum fee is earned.
- Filing work is earned as soon as we start preparing your USPTO application (identification, specimens, ownership data, etc.).
- Monitoring is earned once monitoring is set up (minimum $150 earned).
Earned vs. refundable fees. Once work begins, the portion of the flat fee corresponding to work performed becomes earned and non-refundable. Any unearned portion, if any, will be refunded per our Refund Policy.
Cancellation fee. If you cancel before work begins, your refund will be reduced by 5% cancellation fee which includes non-recoverable payment-processor fees and our administrative fee. If we decline representation after our conflicts check, you receive a full refund.
USPTO fees. USPTO government fees (per class) are additional and non-refundable once paid to the USPTO.
No guarantee. We do not and cannot guarantee registration, timing, or outcomes. Search reports are professional opinions based on available sources (federal, state, and common-law databases) that may contain limits or lags.
Your responsibilities. You agree to provide accurate, complete information; review and approve filing details; respond promptly to requests; and confirm you have authority to engage us for the trademark owner.
Communication & e-sign. You consent to electronic communications and e-signatures. We may use trusted third-party tools (e.g., Stripe, search platforms) to deliver services and process payments.
Conflicts & acceptance. No attorney-client relationship exists until we complete a conflicts check and either (i) send you a brief email confirming acceptance, or (ii) commence substantive work on your matter (e.g., beginning the search or preparing the application). If we decline after conflicts, we will notify you and refund all amounts you paid.
