    A Tribute to Jodi Krantz

    Waiver & Release of Liability

In consideration of being allowed to participate in the Englewood Parade of Lights (the “Parade”), I, the undersigned participant, representative, or authorized agent of the above-named organization, hereby agree to the following:

Release, Assumption of Risk, and Indemnity

By submitting this form, I am applying to participate in the Event described above (the “Event”) organized by West iNd Connection and held in Independence, Missouri. I understand participation may involve walking near moving vehicles, crowds, noise, and other hazards.

    1. Assumption of Risk

I understand and accept the inherent risks of participating in the Event, including risks of slips, trips, falls, vehicle movement, weather, and crowd behavior.

    2. Release of Claims (Adults)

To the fullest extent allowed by Missouri law, I release and discharge West iNd Connection, Englewood Arts, the City of Independence, their officers, directors, employees, assigns,  and volunteers, and the Event’s sponsors and vendors (the “Released Parties”) from any and all claims for injury or damage arising out of my participation in the Event, including claims caused in whole or in part by the ordinary negligence of any Released Party. This release does not waive claims based on gross negligence, willful or intentional misconduct, or any liability that cannot be waived by law.

    3. Indemnity

I agree to indemnify and defend the Released Parties from claims or damages caused by my own acts or omissions, including violation of Event rules.

    4. Emergency Medical Authorization

In the event of injury or illness, I authorize the Parade organizers to secure emergency medical treatment for myself (or for the minor participant). I understand that reasonable efforts will be made to contact emergency contacts, but if they cannot be reached, this authorization allows treatment to proceed. I agree to assume financial responsibility for all expenses related to such care.

    5. Photo/Video

I grant West iNd Connection a non-exclusive right to use Event photos/video of me for news and promotional purposes without compensation.

    6. Safety Compliance

All participants must follow Parade rules, instructions from Parade officials, and applicable laws. Participant acknowledges that they have been informed of the Parade rules, has reviewed and understood them to the extent provided, and agrees to comply with all such rules, as well as any instructions issued by Parade officials. Unsafe behavior or failure to comply may result in immediate removal from the Parade and potential disqualification from future events.

    7. Rules and Compliance

I will follow all Event rules and City of Independence requirements, including any special-event permit conditions and insurance requirements applicable to my unit. If I drive a vehicle in the Event, I will carry valid registration, a current proof of insurance, and drive lawfully at a walking pace with safe spacing.

     8. Minors

If I am the parent or legal guardian of a participating minor, I consent to the minor’s participation in the Event and accept responsibility for ensuring the minor’s supervision as required by the Event rules.

I understand and acknowledge that, under Missouri law, pre-injury waivers that purport to release a minor’s own claims may not be enforceable. Accordingly, this Agreement does not waive or release the minor’s independent claims, if any.

To the fullest extent permitted by Missouri law, I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, damages, costs, and liabilities asserted by or on behalf of the minor to the extent such claims result in or give rise to claims brought by me in my own capacity (including, without limitation, claims for medical expenses, loss of services, or other damages that I may personally assert as a parent or guardian).

I further agree that this indemnification obligation is intended to be clear, unequivocal, and conspicuous, and includes claims arising out of the ordinary negligence of the Released Parties, but does not extend to gross negligence, reckless misconduct, or willful or wanton acts.

These revisions explicitly recognize that a minor’s claims cannot be waived, use the ‘defend, indemnify, and hold harmless’ triad with clear scope, emphasize the parent’s assumption of responsibility for their own derivative claims, and carve out gross negligence or willful misconduct.”

    9. Governing Law and Jurisdiction

This Waiver & Release of Liability and all matters arising out of or relating to this Waiver & Release of Liability shall be governed by and construed in accordance with the laws of the State of Missouri. Any disputes arising out of or related to this Agreement shall be resolved in a state or federal court of competent jurisdiction located in or nearest to Jackson County, Missouri.

    10. Severability

If any term, provision, covenant, or condition of this Waiver & Release of Liability is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

    11. Signature

I have read and understand this agreement. I am 18 or older and competent to sign
