1. Parties to this Agreement
By registering and paying for enrollment in The King's & Queen's Code Academy (referred to as "The Academy"), the Parent/Guardian (referred to as "I," "Me," or "Parent") agrees to these terms on behalf of themselves and the enrolled student (referred to as "Student").
2. Acknowledgment of Program and Virtual Risk
I understand that The Academy provides virtual computer science, design, and computational thinking instruction. I acknowledge the unique risks inherent in an online environment:
Technology Reliance: The Academy relies on the Student's functional, secure computer, reliable Internet connection, webcam, and microphone. I am solely responsible for providing and maintaining all necessary equipment and connectivity. The Academy is not responsible for any learning loss, missed instruction, or technical issues resulting from my or the Student's hardware, software, or Internet service provider failure.
Third-Party Platforms: The Academy uses third-party platforms (including, but not limited to, Scratch, EarSketch, Google, and video conferencing tools). I accept all risks associated with the Student's use of these platforms and understand that The Academy is not responsible for their security, policies, or operation.
Supervision: The Academy operates virtually. I acknowledge and agree that the Student remains under my general supervision and control at all times during and outside of class sessions. The Academy is not responsible for the Student's conduct, actions, or physical environment outside the view of the classroom camera.
3. Release and Waiver of Liability
In consideration of the Student's enrollment, which I consider to be of substantial value, I voluntarily agree to accept and assume all risks inherent in the Student's participation in The Academy's activities.
I agree, on behalf of myself and the Student, to release, indemnify, and hold harmless The King's & Queen's Code Academy, its owners, directors, instructors, and staff (collectively, "Released Parties") from any and all claims, demands, liabilities, suits, costs, or causes of action arising from the Student's enrollment or participation, including any claims based on the negligence of the Released Parties.
This Release and Waiver applies to any and all loss, damage, injury, expense, or death relating to:
The quality of the instruction or the Student’s inability to grasp course material.
The results of any certification exam, college application, or job placement after completing the program.
Any breach of privacy or security arising from the use of third-party platforms.
Any harm related to the Student's interaction with other participants or instructors outside of recorded class sessions.
4. Code of Conduct, Termination, and Refund Policy
I understand that The Academy maintains a zero-tolerance policy for harassment, discrimination, or inappropriate online behavior.
I agree that The Academy reserves the right to immediately suspend or permanently terminate the Student's enrollment, without refund, if the Student violates the Code of Conduct.
I acknowledge that all enrollment fees, including tuition and any supplemental charges, are non-refundable and non-transferable. This no-refund policy applies regardless of the reason for withdrawal, non-attendance, or termination due to disciplinary action.
5. Photo, Video, and Media Release
I grant The Academy, its employees, agents, and representatives, the irrevocable and unrestricted right to photograph, record, and videotape the Student while participating in the program.
I consent to the use of the Student's name, likeness, voice, image, and student work/projects in any and all media, including but not limited to: promotional videos, website content, social media campaigns, print materials, and internal training.
I agree that the Released Parties may use and publish such items for promotional purposes without compensation to me or the Student. I release the Released Parties from any and all claims and demands arising out of or in connection with the use of the Student's likeness, including any claims for defamation or invasion of privacy.
6. Mandatory Acceptance and Signature
I confirm that I have read and understand this entire Acknowledgment and Waiver of Responsibility, including the Non-Refundable Policy and the Media Release. I understand that by checking the box below, I am accepting all terms as a mandatory condition of enrollment.
