Terms & Conditions

All applications are subject to approval by Hoshyla Farms. Submission of an application does not guarentee acceptance as a vendor of the Hoshyla Farms Lavender Festival. The $25.00 jury fee is Non-Refundable

1. I have read the rules and regulations of the Hoshyla Farms Lavender Festival and agree to abide by all the rules and regulations

2. I agree that before offering and selling a product, I will become familiar with and comply by all applicable Suffolk County Department of Health codes and regulations.

3. I verify that all information I provided on this application and about my products in true and accurate

4. I will cooperate with Hoshyla Farms staff and security

5. I will not sublet or loan out my designated space

6. I understand that failure to comply with the Rules and Regulations of the Lavender Festival could mean dismissal from the festival with no return of funds

7. I will not resort to litigation against the Lavender Festival its management, Hoshyla Farms, LLC, and/or its landlord. I will limit any claim I may have because of a decision by Hoshyla Farms which results in a denial of acceptance, denial of product sales, or wrongful suspension or termination from the event to a return of fees paid to Hoshyla Farms.

8. I understand that I must be fully committed to participate in the event dates signed up for.

9. I understand that in the event I do not show for the event no refunds are given.

10. I understand that I am responsible to provide my own tent, chairs, and tables for set up of my paid for space and that stakes and a minimum of 25 pound weights are required on each corner of my tent.

11. I agree to allow Hoshyla Farms, LLC to use images from my social media, website, and/or images provided in the application for promotion of the event.

12. I agree to allow Hoshyla Farms, LLC to use any photos taken at their events to be used for the promotion of the Lavender Festival and other events on the farm.

13. I understand that there are NO refunds and in the event of inclement weather the event may be canceled and there will be no refund given.

INDEMNIFICATION AGREEMENT

Vendor agrees to indemnify and hold Hoshyla Farms, LLC and their respective officers, employees, agents, hired event management and consulting company, representatives and officials and property owner harmless from any and all loss, claim, actions, costs, or liability associated with its use of the property and related activities described herein, including liability for damages to property or for injuries or death to persons which may arise from, or be attributable or incident to the use by Vendor and its employees, agents, representatives, and concessionaires of the property, excepting liability solely caused by the gross negligence of Hoshyla Farms, LLC or other property owners or its employees, agents, or representatives. Without limiting the generality of the foregoing, Vendor agrees to indemnify and hold Hoshyla Farms, LLC and/or their respective officers, employees, agents, hired event management and consulting company, representatives and officials and property owner harmless from any lien claimed or asserted for labor, materials, or services furnished to Vendor in connection with the use of the property. With respect to any suit or claim by Hoshyla Farms, LLC or their respective officers, employees, agents, hired event management and consulting company, representatives and officials and property owner, whether under this indemnification provision or otherwise, Vendor, for itself, its agents, employees, and representatives, hereby expressly waives any defense which might preclude or limit either enforcement of this indemnification clause or any reasonable attorneys fees incurred by Hoshyla Farms LLC, and/or their respective officers, employees, agents, hired event management and consulting company, representatives and officials and property owner securing compliance with the provision of this indemnification agreement. I understand and agree that I alone am responsible for my property and person at all times at The Hoshyla Farms’ Lavender Festival organized by Hoshyla Farms, LLC. I understand and agree that Hoshyla Farms, LLC retains the right to prohibit any sale by any vendor at its absolute discretion. All Payments are non-refundable.
