In consideration of being permitted to use the facilities, equipment, and premises at Triumph Barbell LLC, I, the undersigned, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby agree as follows:

1. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

• I understand that the use of fitness equipment, weightlifting, and participation in gym-related activities involves inherent risks of physical injury, including but not limited to muscle strains, sprains, broken bones, permanent disability, and death. These risks may arise from my own actions or inactions, the actions or inactions of others, or the condition of the facilities or equipment.
• I voluntarily assume all such risks and agree that Triumph Barbell LLC, its owners, employees, agents, affiliates, and insurers shall not be liable for any injuries (including death), damages, or losses sustained by me or my guest(s), including any minor(s) under my supervision, whether caused by negligence or otherwise.
• I certify that I am physically fit and have no medical condition that would prevent my safe participation in physical activities at Triumph Barbell LLC. I understand that I am solely responsible for consulting a physician before beginning any exercise regimen.

2. RELEASE AND WAIVER

• I hereby fully and forever release, discharge, and hold harmless Triumph Barbell LLC, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to my (or my minor child’s) participation in gym activities or use of equipment, whether occurring on the premises or as a result of travel to and from the facility.
• In the event of an emergency, I authorize Triumph Barbell LLC to secure medical treatment deemed necessary, and I agree to be responsible for any resulting medical expenses.

3. INDEMNIFICATION

• I agree to indemnify and hold harmless Triumph Barbell LLC from any and all claims brought by or on behalf of any person (including minors) arising from injuries or damages sustained by me or my child in connection with our use of the facility.

4. USE OF FACILITIES AND RULES

• I understand that Triumph Barbell LLC may not provide supervision, instruction, or assistance during use of its equipment or facilities. I agree to follow all rules and regulations set forth by Triumph Barbell LLC and to use the facilities and equipment only in a manner consistent with their intended purpose. I accept full responsibility for my conduct and that of any minor(s) accompanying me.
• I understand that Triumph Barbell LLC allows its members and guests to record their own training for personal or social media use. By entering the facility, I acknowledge that I may appear in the background of such recordings, and I consent to this incidental inclusion without expectation of compensation or notification.

5. PERSONAL PROPERTY

• I understand and agree that Triumph Barbell LLC is not responsible for any lost, stolen, or damaged personal items.

6. PHOTOGRAPHY AND VIDEO RELEASE

• I grant Triumph Barbell LLC the right to photograph or record me while on the premises and to use such images or recordings for promotional purposes in print or digital form, including but not limited to social media, marketing, or advertising, without compensation.

7. GOVERNING LAW

• This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. Any legal action arising out of this agreement shall be brought in the courts located in the City of Lowell, County of Middlesex, Massachusetts.

8. SEVERABILITY

• If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. MINOR PARTICIPATION (if applicable)

• Triumph Barbell LLC permits minors aged 12 and older to use the facility with the express written permission of a parent or legal guardian. As the parent or legal guardian of the minor named below, I consent to the terms of this agreement and accept full responsibility for the minor’s participation and safety. I agree to all provisions herein on behalf of the minor and will ensure the minor abides by all gym rules and guidelines.
