NH Combo Hoops LLC – Waiver & Release of Liability
This Agreement (“Agreement”) is entered into by and between NH Combo Hoops LLC (“Company”) and the undersigned paren't/guardian and trainee (“Client” and “Participant”) for the provision of 1:1 basketball training services and related activities.
- Compliance with Rules and Conduct
Client and Participant agree to follow all Company rules, instructions, and conduct expectations during training sessions.
- Medical Authorization
Client grants permission for Participant to receive emergency medical treatment if necessary during participation in Company training sessions or related activities.
- Agreement to Terms
Client and Participant confirm they have read and agree to all terms outlined in this Agreement.
- Media Release
Client grants the Company permission to use photographs, video, and images of the Participant taken during training sessions for promotional and educational purposes without compensation.
- Facility Use and Participant Responsibilities
Participant agrees to:
- Dress appropriately for all training sessions.
- Refrain from bringing food or beverages, other than water, into the training area.
- Help maintain cleanliness and condition of facilities and equipment.
- Assumption of Risk
Client acknowledges that basketball training and related physical activities involve inherent risks of injury, illness, or death. Client voluntarily assumes all risks associated with Participant’s involvement, including injury or harm arising from the use of equipment, facilities, or premises, whether caused by the negligence of the Company or otherwise.
- Release of Liability
To the fullest extent permitted by law, Client releases, waives, and discharges NH Combo Hoops LLC, its owners, employees, contractors, agents, affiliates, successors, and assigns from any and all claims, liabilities, damages, or causes of action arising out of or related to Participant’s involvement in Company training activities, including travel to and from training, except in cases of gross negligence or intentional misconduct.
- No Guarantee of Results
Client understands that participation in 1:1 training does not guarantee specific performance outcomes, skill development results, or athletic achievements.
- Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire.
- Acknowledgment and Understanding
Client acknowledges they have read this Agreement thoroughly, understand its terms, and sign voluntarily without duress or undue influence.
