Completing this form serves as an agreement to our Statement of Work:
A waiver review process will begin at least 5 business days prior to your scheduled event date. An MHA team member will review the waivers via the Smartwaiver Console portal, and any partial or incomplete waivers will be flagged and returned to the point of contact for required updates. Any participant without a signed and completed waiver will not be permitted to participate in the event activities. If a participant is over the age of 18 and does not complete the waiver prior to the event day, a QR code directing them to the online waiver will be available on the day of the event, and must be completed prior to participation on low or high ropes activities.
For programs involving the aerial teams course or aerial adventure park, all participants will be privately weighed at the pavilion by an MHA team member upon arrival. Participants weighing 300 pounds or more will not be permitted to participate in activities on the aerial adventure park or aerial teams course.
Program Changes & Cancellation Policy
A minimum headcount is due two weeks prior to the event date to mha@crossnore.org to aid in staffing ratios.
Crossnore requires written notice of cancellation at least 7 days prior to the scheduled program date. For cancellations made by the CLIENT within 7 days of the event, a cancellation fee of 20% of the total project cost will apply.
If Crossnore cancels a program due to weather conditions (such as lightning, high winds, or extreme cold) or other unforeseen circumstances, participants may reschedule for another available date or time.
Payment Terms
Crossnore will submit an invoice within 30 days after completion of the event and payment is due in full upon receipt. The total invoice will be based on the final headcount in attendance for the event, or the minimum headcount provided by the CLIENT, whichever is greater.
All out-of-pocket expenses (e.g., materials, travel, mileage, lodging, transportation) incurred by Crossnore in connection with the Project will be paid by the Client. All such expenses will be itemized when billed. Crossnore will use its best efforts to minimize those expenses over which it has control, and the Client will approve all expenses prior to payment.
Indemnification
The Parties to this SOW agree to indemnify and hold the other Party harmless from and against any and all loss and damage, and any and all claims, demands, suits, liabilities and payments, including cost of defense, arising in whole or in part, out of the negligent act or omission of the party, its officers, employees, agents or subcontractors, or the negligent act or omission of any person for which a party or subcontractor is held liable. However, if any losses, damages, claims, demands, suits, liabilities and payments, including cost of defense, arise out of or result from the concurrent negligence of both parties, their officers, employees, agents, subcontractors or any other person for which a party is held liable, this indemnity provision shall be valid and enforceable only to the extent of the negligence of any indemnitor's officers, employees, agents, subcontractors, or any other person for which an indemnitor is held liable.
Other Material Terms, Chaperone Requirements & Termination of SOW
The Parties agree that no member of either party will commit any act or do anything which might reasonably be considered to negatively affect the reputation and goodwill associated with the Parties to this SOW, or any of its employees, subsidiaries, or affiliates. As such, Crossnore reserves the right to terminate the SOW, without penalty, should any action occur during the term of this Agreement. When applicable, a minimum ratio of one adult chaperone to ten youth (1:10) is required. Chaperones must remain with and supervise their youth at all times, and are responsible for the conduct and appropriate supervision of the minor(s) and young adult(s) they are accompanying. Failure to adequately supervise your group may result in termination of the SOW.
