MODEL RELEASE

By signing below, I (Client) am agreeing to: 

Tabby Z Photography has the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:

 To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising, trade, share images from my session on social media and for marketing purposes without compensation. 

 I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

SESSION INVESTMENT

All sessions include the digital portraits delivered via online digital gallery. With each gallery you will have the ability to download the photos straight to your computer/device and I also include the rights to print. I pride myself on not putting a limit to the amount of photos you receive. I edit every pose that comes out to my aesthetic and quality. (minus the duplicates of course because who needs 27 photos of the same pose?! Am I right? ha!) 

Please note: A $200 Holiday fee is added to sessions that need to be during Thanksgiving and Christmas Holiday weekends. (ie: day after/weekend of Thanksgiving, Christmas eve/weekend of Christmas.)

*Ideal for Extended Family, Engagement, Seniors (with only 2 outfit changes and one location) Fresh 48 & Lifestyle Newborn sessions.*

* Up to 45 min on-location session 

* 2 outfit changes if wanted

-I pride myself on having your photos back to you within 5 business days or less and NOT putting a limit to the amount of photos you receive as I edit every pose (minus the duplicates) that comes out to my aesthetic and quality. There are no hidden fees, it’s all inclusive pricing.

CONTRACT

 

Please note: A $200 Holiday fee is added to sessions that need to be during Thanksgiving and Christmas Holiday weekends. (ie: day after/weekend of Thanksgiving, Christmas eve/weekend of Christmas.)

The content of the gallery is in discretion of Tabby Zgabay. Tabby will select the best images and edit them to her discretion. Any further editing or culling will be subjected to fee.

Images will be delivered 5 business days beginning the next business day after the session. Images are delivered via instant digital download via Pixieset. 

Client is responsible for making a backup of all photos from the digital download. Photographer will make every attempt to keep archival copies of photos, but does not guarantee that they will be retained indefinitely. Should you lose your photos and need the photographer to re-upload them, there is a re-upload fee of $50.

 

Please be aware of your artist's style and aesthetic before booking. Please note that FB is always more up to date. 

 

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Tabby Z Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Tabby Z Photography. Client shall assist and cooperate with Photographer in obtaining desired photographs. Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation.

CLIENT agrees to carefully select wardrobe and make sure it is free of wrinkles and stains. Client must also feel comfortable in what they are wearing. Tabby Z Photography is not responsible for the following: wardrobe malfunctions, wrinkles, stains, panty lines, undergarments showing, skin color variations due to natural sun or self-tanning, tags/stickers on clothing, chipped manicure/pedicure, deodorant residue or just simply no longer liking your wardrobe choice.
– If client requests additional retouching due to any of the above named, CLIENT agrees to $100/ hour specialized and additional retouching rate for anything that goes above and beyond traditional photo editing and retouching.

Client will be respectful to Photographer and all parties being photographed. Photographer has the right to end the session, without refund, if there is lack of cooperation or respect.

Client will not hold Photographer or the owner of the property liable for any injury that may occur during the session.

Should anyone within your family/party become ill before your session, please let Tabby know immediately.  Should anyone attend a session and is visibly ill, it is within Tabby's right to reschedule the session immediately. 

(Due to the nature of my work, I am required to be very careful with what I allow myself to be around. Thank you for understanding.) 

Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs.  In the event of a cancellation or postponement of the portrait session/agreement by Client, the retainer paid is non-refundable. Retainers are transferable if a date change is necessary. This can only happen ONCE with out a new retainer. Seventy-two hours (72) notice of postponements or cancellations is appreciated. If more than one date change is necessary then another retainer needs to be paid.  If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge. Session must be rescheduled with in 6 weeks, if not a new retainer must be paid. 

Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. Clients shall not be compensated for the time deducted from session due to late arrival of client. I advise arriving to session 5 minutes early so we can start on time.

Tabby Z Photography will retain the full copyright on all images (including digital files) and reserves the right to display, publish/etc. for any reason. Client is prohibited from further editing of images. Client is also prohibited from using photos in contests without written consent from Tabby Zgabay. Client may not, for any reason sell their images to any third party. Client will be granted printing rights in writing for the images and is allowed to download and use digital files for printing purposes and their chosen vendor.
