Puppies can become stressed by the change in environment. Minor problems such as diarrhea, hernias, coccidia, upper respiratory, kennel cough, giardia, worms, etc. may occur and should be treated. These conditions are the responsibility of you, (the buyer), not the seller, and should be checked by a licensed Vet. These and other minor health problems are not covered by this guarantee. Any existing conditions listed in advance will not be covered by this guarantee. This guarantee does not include any injuries or problems the puppy develops due to neglect or abuse by the new owner.
This guarantee does not cover any common puppy ailments such as worms, coccidia and or giardia, vitamin deficiencies, ear infections, any viral, bacterial diseases, disorders brought on by parasites, the development of disqualifying faults, diseases, or disorders, which are due to the BUYER's negligence, chance, or environmental conditions such as missing or misaligned adult teeth, Vaccinosis, Cancer, Addisons, Digestive disorders, Bloat and Allergies. The buyer is responsible for any & all medical or legal costs for puppy, as of this day of purchase. Buyer agrees that they understand that the breeder is not responsible for the buyer’s actions and or decision making in regards to Puppy’s care, including any medical care or procedures, legal issues, or anything effecting this puppy once it leaves the breeder’s hands-on care. The breeder is not liable for any costs that result from buyer’s actions or choices.
Breeder suggests that buyer should consult with breeder if any concerns about their veterinarian's decisions should come up. Breeder is available for consult regarding routine and long-term health. Breeder advises buyers to view veterinarians as small businesses and to always call the breeder if the buyer has any question about the care that the veterinarian is providing to their dog.
B. One Year Genetic Health Warranty:
(This provision is not meant to cover any condition due to the natural aging process, abuse, accident, or neglect on ultimate Owner’s part, an unforeseen hereditary condition from Seller’s part. Recessive genes can and do play a part in genetics that make it impossible to completely rule out hereditary conditions.
A warranty against serious life-altering genetic disease is provided until the dog is one year of age. Should a serious genetic disease be discovered during this time that will greatly alter or shorten the life of the dog, Seller will replace the puppy. Buyer to provide Seller all documentation from the Veterinarian. Seller reserves the right to consult a specialist for a second opinion at Seller's expense.
Refunds are only provided if Luxury Family Companions, LLC determines that they would rather provide monetary compensation for medical expense versus providing another puppy to the customer.
If a refund is agreed upon by Luxury Family Companions, LLC and customer the maximum refund that Luxury Family Companions, LLC will allow for is up to the purchase price of the dog. Luxury Family Companions, LLC will not provide additional funds for veterinary bills and or incidental expenses and other liabilities. We strongly recommend that all customers understand the responsibility of owning a dog and purchase veterinary health insurance for their puppy.
A warranty for severe Hip Dysplasia is provided for one year. Should the dog be found to have severe Hip Dysplasia - within the first year, Seller will provide a replacement puppy or cover the cost of surgery/treatment up to the initial purchase price. Buyer must provide Seller with proof of Hip Dysplasia in the form of x-rays and documentation from OFA that the hips are severely Dysplastic. Seller reserves the right to confirm the results and consult with specialists for a second opinion before a replacement. Seller does not require Buyer to return the dog.
C. Buyer agrees to return the dog to Seller - or allow Seller to re-home dog, should it become necessary. Seller should be the first contact if Buyer can no longer keep the dog. Seller offers a lifetime re-home policy. If you re-home the dog without Seller's permission, the Health Warranty is void. Seller would never want one of its dogs to end up in a shelter, rescue or to be bounced from home to home.
We are always willing to take back a puppy in the event you can no longer care for your dog in the future. In the event a buyer must return a puppy to Luxury Family Companions, LLC by their own choice (life circumstances change etc), the following conditions must be fulfilled:
- Puppy/dog must be returned in good health and with all paperwork to our physical address.
- We must approve in writing the day and time of the puppy’s arrival.
- No refund will be given
- Brighton Bernedoodles or agents will not pay any expenses related to the return of the puppy
D. Luxury Family Companions, LLC puppies are sold on a strict non-breeding contract. Buyer agrees to spay or neuter the dog by one year of age. Buyer must send proof to Seller via, e-mail or upon execution of this contract, Buyer agrees that this dog is being sold as a Pet and will never be used for breeding. Failure to follow through with the spay or neuter contract as outlined above will terminate your Health Warranty. If dog is used for breeding, legal action will be started for the breach in contract. Any legal fees incurred by the Seller to enforce this non-breeding contract are the sole responsibility of the Buyer. There is a fine of $55,000 for the breach of the non-breeding clause in this agreement. If the buyer wishes to purchase a breeding dog this must be stated and a separate breeding contract is drafted. This contract is not intended for the sale of breeding or show dogs.
E. Seller will provide a size range estimate of the dog based on the parents, grandparents and years of experience. Seller cannot guarantee the size, color or shedding level of the dog.
F. Shipping fees are non-refundable. Responsibility of the Buyer - Maintenance: Owning a puppy means occasional trips to the vet. You, (the buyer), are responsible for all costs of these trips. Take your puppy to the vet within 36 hours of arriving home for an exam, or the health guarantee portion of this contract will not be valid. It is up to you to provide your puppy with the routine preventative care it needs, annual physical exams by a licensed veterinarian and following the veterinarian’s guidelines for vaccinations and de-wormings are the sole responsibility of the buyer. The Seller will not be responsible for ANY medical expenses incurred.
I. Buyer agrees to maintain the puppy in good health, provide routine preventative health care including, but not limited to, a grade A large breed puppy food, vaccinations, internal and external parasites, heartworm prevention, flea and tick control, regular baths, grooming and any other preventative medication a Veterinarian feels is needed. If any of the above preventative care has not been provided, the health warranty will be void.
II. Buyer agrees the puppy will be raised as an inside family pet. Buyer agrees the puppy will not be left outside for extended periods or overnight unsupervised. Buyer agrees to keep the dog in the house as a beloved family member and not outside or in a doghouse separate from the main residence.
III. Buyer agrees to maintain the puppy at a good healthy weight. The health warranty will be terminated should the dog be allowed to become overweight or developing joints be overstressed at any point during the first two years. Running for miles with your puppy, jumping in and out of the car/beds and running up and down stairs greatly impacts the hips and knees during the developing age. A large breed, dog's growth plates close at 13 months old so this is a good time to slowly start more strenuous exercising with your dog.
Social Media Clause- At Luxury Family Companions, LLC we strive to make all of our puppy buyers happy and content with matters pertaining to the new puppy. Please contact us in writing and allow for up to 30 days from first notified to resolve any and all matters before posting to social media. Luxury Family Companions, LLC is willing to work to find resolution to matters a buyer might encounter. Please allow 30 days from the initial contact of said matter for buyer and Luxury Family Companions, LLC to come to a resolution. We are a family business and work with many other families to make their dreams of getting a great puppy come true. We would love to talk to you and work with you if you have a concern.
Seller’s Representations and Warranties- Seller represents and warrants that on the closing date, the puppy will be in good health and the puppy will have received all necessary, age-appropriate vaccinations and de-worming. Buyer agrees and acknowledges that seller has made no promise, representation or warranty that the puppy will be non-shedding or non-allergenic. Buyer also agrees and acknowledges that the puppy’s size, color, coat appearance and physical/behavioral traits are not predictable and that seller makes no promise, representation or warranty regarding the size, color, coat appearance or any physical/behavior trait of the puppy.
Breed verification and genetic verification clause- Due to the infancy and inaccuracy of DNA breed verification tests we do not guarantee the results of any genetic test that claims to provide ancestry information. All dogs have had infusions of various breeds in the past. Purebred poodles as we know them today have had infusions of various breeds including but not limited to: Irish setter, Afghan hound, Bichon Frise, Australian Shepherd, Cavalier King Charles Spaniel etc. Certain colors/patterns and conformational traits in the modern day poodles were developed through select infusions.
Under no circumstances shall the Seller be liable to the Buyer or to any third party for any consequential, incidental or special damages resulting from or in a manner related to the puppy or dog. Upon execution of this contract all Veterinary and Medical care and its associated costs are the sole and exclusive responsibility of the Buyer.
You shall not disparage, defame, or discredit any member or employee of Luxury Family Companions, LLC or engage in any activity which would have the effect of disparaging, defaming, or discrediting Luxury Family Companions, LLC, or its members, managers, affiliates, officers, directors, employees or agents in their respective capacities as members, affiliates, officers, directors, employees or agents, in any way.
Buyer’s Representations Buyer represents to Seller that: (a) Buyer will have the Dog spayed or neutered by the age of twelve months. (b) The Dog will reside with Buyer as companion pet to Buyer and Buyer’s family. (c) Buyer will keep the Dog in an enclosed area of adequate size, and will not allow the Dog to roam at will. Buyer will not keep the Dog chained or tethered or permanently house the Dog in a kennel. (d) Buyer will provide the Dog with nutritious food and necessary veterinary care, including deworming, heartworm prevention and regular vaccinations (including rabies). (e) Buyer is not acting as an agent for any other person or business in the purchase of the Dog. (f) Buyer will not sell, give, or release the Dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility.
