Terms and Conditions for The Natural State Moto Escape LLC

Each participant guarantees:
· This form, as well as submitting payment serves as an agreement that the rider agrees to these Terms and Conditions and acts as a binding agreement between the rider and Natural State Moto Escape LLC.
· Safety is the number one priority. Riders should have fun while on the designated course but should participate at their own discretion. The rider is always responsible for assessing the situation at hand and determining if it’s within his/her ability level. If you do not feel comfortable or believe an area is outside of your riding ability, do not ride this section of the track.
· Please do not litter. Pick up after yourself and others, let’s keep Arkansas Forests as clean and beautiful as possible. The Forest Service and Arkansas Game and Fish provide trashcans at major campgrounds and gas stations have plenty of public trash cans.
· Cancellations and Refunds: Cancellations that are received more than 30 days prior to the start of the tour will be refunded with a 4% processing fee. Cancellations received less than 30 days prior to the event will not be refunded. The Natural State Moto Escape LLC will be released from its obligations under these terms and conditions in the event of a cancellation of the tour that is affected by unforeseeable circumstances outside of its control that couldn’t be avoided despite exercising due care. In this unfortunate event, The Natural State Moto Escape LLC will not be held liable for any additional costs, losses, or inconvenience to the participant as a result of the change(s) to the event and The Natural State Moto Escape LLC will refund the full amount to the participant if the event is cancelled before the starting date.
· Release and Waiver The participant and anyone claiming on The Natural State Moto Escape LLC’s behalf releases and forever discharges The Natural State Moto Escape LLC and its affiliates, successors, officers, employees, representatives, partners, agents and anyone claiming through them (collectively, the “Released Parties”), in their individual and/or corporate capacities from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature and kind, known or unknown, which the participant has or ever had or may in the future have against The Natural State Moto Escape LLC or any of the Released Parties arising out of or relating to the participant’s claims. Each participant is required to accept this release of liability before beginning the tour.
· General requirements:
o Must wear a helmet
o Must be 18 years or older
o Must have a valid motorcycle license and licenses
o Must have previous riding experience
· The Natural State Moto Escape LLC is not liable for any damage to; the participant, his property, family, heirs, or assigns in the event of drops, spills, or wrecks including (but not limited to) while in transit to/from the event, while on the property, or participating in camping. The Natural State Moto Escape LLC will not be held liable for any mechanical issues to the participant’s motorcycle if such an event occurs. Failure to inspect, maintain, or take proper care of your bike is not our responsibility, you must check for proper operation before the ride.
· The Natural State Moto Escape LLC is not liable for any damage to property caused by the rider due to improper behavior, including designated camping sites, private property, nor any fines/tickets assigned to the participant due to improper riding and/or not obeying local laws and regulations. Please be courteous and leave no trace whenever possible.
· The Natural State Moto Escape LLC’s attempts to lay the entire track on public land, roads, and trails besides the ending point at Iron Mountain CMA campground. If you find yourself off the designated course or feel uncomfortable with a certain section of the course, you can always find a main road and reconvene with the designated course shortly down the road. Sections of the designated track may change from the creation of the track to the start of the ride. Once again, if you feel like you are violating any law/rule just turn around and catch the track at a further point. You are not required to ride any particular section(s) of the track. If you are following the designated tour route and end up at a private property sign, turn around and let us know. The Natural State Moto Escape LLC is not liable for any participant caught trespassing or violating United States Forest off highway touring rules.
· The Natural State Moto Escape LLC holds the right to change routes due to weather conditions, unforeseeable circumstances, or any other services as deemed necessary to provide an equivalent experience in the event of the forementioned circumstance(s) without notice to the tour participant. The Natural State Moto Escape LLC attempts to choose a suitable date for proper and more comfortable riding conditions, but will not be responsible for inapt weather conditions that may occur during the designated excursion. The participant holds no claim to any kind of reimbursement of the tour price. The participant is responsible for gearing up accordingly for the types of weather that will be present during the tour date(s).
· It is the participant’s responsibility and crucial to an enjoyable riding experience that he/she is in good physical fitness, stamina, and is properly geared. Some sections of the track may be tough, and by agreeing to these terms and conditions the participant states that he/she has had offroad experience and will ride with skill, care, and confidence.
· It is the participant’s responsibility to ensure that he/she is in good health standing prior to the start of the tour. The use of drugs, alcohol, or medication that impairs safe riding while on the designated course is strictly prohibited. Any participants caught using impairing substances, or riders not of good health standing may be excluded from participation.
· Any disputes shall be settled by the Montgomery County Circuit Court, Mount Ida, AR, using Arkansas law.
· In the event of a lawsuit, action or other legal proceeding event in connection with investigating, interpreting, or enforcing these terms listed the prevailing party shall be entitled but not limited to compensate for court filing fees, court costs, arbitration fees/costs, witness fees, and disbursements of legal counsel, investigators, expert witnesses, accountants, or any other professionals. In addition to the forementioned, the prevailing party’s attorney fees are to be set by the court at trial and on any appeal therefrom.
Gear Hauling Service. The participant agrees to hold anyone claiming on Natural State Moto Escape's behalf free from any liability if gear is lost or damaged. Gear will be tagged and a duplicate tag will be given to the participant to keep up with and retrieve their gear.

The GPX file provided for the event is not to be shared with anyone who is not participating in the event.
By paying the registration fee, I (the participant) understand and agree to all terms and conditions stated in this waiver and my payment serves as my signature and agreement.
