Terms & Conditions and Waiver of Liability
By registering for and/or participating in any Boogie Babies class, session, workshop, event, or program, the participant acknowledges that they have read, understood, and agreed to the following Terms & Conditions and Waiver of Liability.
1. Registration and Payment
Full payment and completed registration are required prior to participation in any Boogie Babies program. Registration is not considered confirmed until payment has been received and processed.
Boogie Babies reserves the right to refuse participation to any individual whose registration or payment has not been completed prior to the scheduled class time.
2. Class Cancellations by Boogie Babies
Should a class be cancelled by Boogie Babies due to inclement weather, instructor illness, facility closure, scheduling conflicts, or any other circumstance beyond the reasonable control of Boogie Babies, a make-up class will be offered whenever reasonably possible.
If a participant is unable to attend the designated make-up class, a credit equivalent to the value of the cancelled class will be issued to the participant's account for future use.
Boogie Babies reserves the sole discretion to determine the timing, location, and format of any make-up class.
3. Participant Absences
No refunds, credits, transfers, or make-up classes will be provided for classes missed due to personal circumstances, including but not limited to illness, vacation, travel, scheduling conflicts, work commitments, or other participant-related reasons.
Participants are encouraged to review their schedules carefully before registering.
4. Known Absences Prior to Registration
Participants who know prior to registration that they will be unable to attend one or more classes during a session must notify Boogie Babies before completing registration.
At the sole discretion of Boogie Babies, a class credit, prorated registration adjustment, or make-up opportunity may be provided for pre-disclosed absences.
5. Maternity Leave Return Accommodation
Participants returning to work following maternity or parental leave who are unable to attend an entire session should contact Boogie Babies prior to registration.
Where appropriate, Boogie Babies may provide a prorated registration option or discount code reflecting the number of classes the participant is able to attend. Such accommodations must be arranged before registration is completed and remain at the sole discretion of Boogie Babies.
6. Refund Policy
All registrations are final.
Refunds will not be issued once a session has commenced except where required by applicable law. Requests submitted prior to the start of a session may be considered on a case-by-case basis and may be subject to administrative fees.
7. Credit Policy
Credits issued by Boogie Babies have no cash value, are non-transferable, and may only be applied toward future Boogie Babies programs.
Unless otherwise specified in writing, all credits expire twelve (12) months from the date of issue.
Unused credits remaining after the expiry date shall be forfeited.
8. Assumption of Risk
I acknowledge that participation in Boogie Babies programs involves physical movement, exercise, dance, fitness activities, and related activities that carry inherent risks, including but not limited to bodily injury, illness, property damage, or, in rare circumstances, death.
I understand that participation is voluntary and that I freely assume all risks, known and unknown, associated with participation in any Boogie Babies program.
Where I attend with an infant or child, I acknowledge that I remain solely responsible for the supervision, safety, and wellbeing of my child at all times.
9. Health Acknowledgement
I acknowledge that I have been advised to consult with a physician before participating in any exercise program.
By registering, I represent and warrant that I am in sufficient physical condition to safely participate in the activities offered by Boogie Babies and that I will discontinue participation and seek appropriate medical advice should I experience any condition that may affect my ability to participate safely.
10. Waiver and Release of Liability
In consideration of being permitted to participate in any Boogie Babies program, I, on behalf of myself, my heirs, executors, administrators, personal representatives, and assigns, hereby fully and forever release, waive, discharge, and hold harmless Boogie Babies, its owners, directors, officers, employees, contractors, instructors, volunteers, agents, successors, assigns, and any facilities used in connection with its programs (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, and expenses arising from or related to any injury, illness, death, property damage, or other loss sustained by me or any child accompanying me as a result of participation in any Boogie Babies program.
This release applies to all claims, including those arising from the negligence of the Released Parties, to the fullest extent permitted by law.
I further covenant and agree not to commence or maintain any lawsuit, claim, or proceeding against the Released Parties for any matter released herein.
11. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of or related to my participation in any Boogie Babies program or the participation of any child accompanying me.
12. Emergency Medical Authorization
In the event of an emergency, I authorize Boogie Babies and the Released Parties to obtain medical assistance or treatment deemed reasonably necessary.
I acknowledge that I am solely responsible for any and all costs associated with such treatment, transportation, or medical services.
13. Photography and Media Release
I acknowledge that classes, events, and programs may be photographed or recorded for promotional, educational, and marketing purposes.
By registering, I grant Boogie Babies the unrestricted right to use photographs, video recordings, and other media containing my likeness and/or the likeness of my accompanying child in print, digital, social media, website, and promotional materials without compensation.
Boogie Babies will not intentionally publish participant names or other identifying personal information without separate consent.
14. Privacy Policy
Boogie Babies is committed to protecting the privacy and confidentiality of participant information.
All personal information collected is used solely for the administration and operation of Boogie Babies programs and services. Information will never be sold, rented, or provided to third parties except where required by law or reasonably necessary for program administration.
All client information is stored securely using password-protected computers, databases, cloud storage systems, and other reasonable safeguards designed to protect against unauthorized access, disclosure, alteration, or misuse.
15. Program Changes and Force Majeure
Boogie Babies reserves the right to modify class schedules, instructors, locations, program content, or policies where reasonably necessary.
Boogie Babies shall not be liable for delays, interruptions, cancellations, or inability to provide services resulting from events beyond its reasonable control, including but not limited to severe weather, natural disasters, public health emergencies, government restrictions, labour disruptions, utility failures, or facility closures.
16. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any dispute arising from participation in a Boogie Babies program shall be subject to the exclusive jurisdiction of the courts of Ontario.
17. Acknowledgement and Acceptance
By submitting a registration form, completing payment, attending a class, or otherwise participating in any Boogie Babies program, I acknowledge that:
- I am at least eighteen (18) years of age;
- I have carefully read and fully understand these Terms & Conditions, Assumption of Risk, and Waiver of Liability;
- I understand that I am giving up certain legal rights, including the right to sue;
- I agree that this agreement is binding upon me, my heirs, executors, administrators, personal representatives, and assigns; and
- I voluntarily accept and agree to all terms contained herein.
