Participant - Assumption of Risk/Release of Liability
I am 18 years of age and the named camper above. I understand the nature of the above-referenced activities. I am qualified to participate in activities at Emmaus University and verify that I have the appropriate experience and capabilities to participate in any activities. I understand that while participating in this activity, I may be photographed. I agree to allow photos or videos of myself to be used for any legitimate business purposes by Emmaus University, its employees, agents and assigns.
I hereby release, discharge, covenant not to sue and agree to defend and indemnify, save and hold harmless each of the Releasees from all liability, claims, demands, losses or damages on my account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise as provided above. I acknowledge that Emmaus University and its members, managers, employees, agents and contractors (“Releasees”) are NOT responsible for the errors, omissions, acts or failures to act of any person or entity conducting a specific activity. I acknowledge that this activity may involve a test of physical and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by facilities, temperature, weather, condition of participants, equipment, lack of hydration and actions of other people including, but not limited to, participants, volunteers, coaches, parents, officials, umpires, referees, monitors, spectators and sponsors of any activity. These risks are not only inherent to participants, but are also present for volunteers, coaches, parents, officials, umpires, referees, monitors, spectators and sponsors of the activity.
Further, I agree that if, despite the release, I or anyone on my behalf makes a claim against any of the Releasees, I will defend, indemnify, save and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss liability, damage or cost any Releasee may incur as the result of such claim. I hereby release the camp and its volunteers from all claims from injury or illnesses which I may sustain, and authorize the director or his designee to select hospital facilities and/or physician of his choice and authorize treatment of myself (the above named) on an emergency basis in the event such treatment becomes necessary while attending the Emmaus University Athletic Camp.
