GENERAL TERMS & CONDITIONS
When attending any MOVE class, workshop, and/or activity (together, the MOVE activities), I acknowledge and agree that:
- MOVE has taken all appropriate steps to make MOVE activities safe and enjoyable, but unforeseen situations or accidents may occur during MOVE activities beyond the control of MOVE.
- Many MOVE activities entail physical exertion and, where this is the case, I must be in a suitable physical condition to engage in them.
- There are inherent risks associated with MOVE activities and I assume full responsibility for these risks.
- I will not engage in MOVE activities in a manner that endangers myself or others, including attending MOVE activities while under the influence of drugs or alcohol.
- I will immediately communicate to MOVE staff:
a) if I am under the influence of any prescribed medication that may affect my abilities to safely participate in any MOVE activities; and/or
b) any physical or medical conditions requiring special attention in respect to the MOVE activities.
- I will comply with all of MOVE’s rules and policies and all reasonable instructions of MOVE staff.
- If my behaviour is deemed unsafe, disruptive, inappropriate and/or I fail to comply with any rules or instructions from MOVE staff, I may be asked to cease participation and/or leave the premises, with no entitlement to a refund or compensation.
- In the event that I observe any unsafe conduct or conditions before, during or after MOVE activities, I agree to report the unsafe conduction or conditions to a MOVE staff member as soon as possible.
- I may receive physical adjustments during class to enhance or correct my posture or position, and I take responsibility for alerting instructors of any injuries or impairments which may be affected by these adjustments.
- MOVE (and its respective independent contractors, employees, board officers and volunteers ) make no guarantees with respect to my safety and enjoyment of the MOVE activities, and I will defend and hold them harmless, to the maximum extent permissible at law, against any claims, costs or losses incurred by them in relation to my participation in MOVE activities.
PHOTOGRAPHY AND VIDEOGRAPHY WAIVER
From time to time, a photographer/videographer may be present at MOVE activities. On such occasions, all participants will be informed that images will be taken.
I must inform MOVE staff if I do not agree to MOVE taking photos and videos of me. If I do not do so, then I acknowledge and agree as follows:
- I give permission to MOVE to take photographs and videos of me during MOVE activities in which I participate.
- All photographs and videos of me are the exclusive property of MOVE, and MOVE has the exclusive right to use, reproduce, distribute and publish any photographs and videos of me (including but not limited to in print and electronically) and may use such photographs and videos, with or without my name, and for any lawful purpose including but not limited to publicity, education, advertising, promotion, social, and/or web content.
- I waive any right to inspect or approve the finished product where my likeness appears in such media.
- I waive any moral and legal rights, and any rights to royalties or other compensation, related to the use of any photograph or video of me participating in MOVE activities.
