HOLD HARMLESS AGREEMENT
This Agreement (“Agreement”) is entered into by and between NFHCS, its officers, directors, employees, volunteers, agents, and affiliates, and the undersigned Participant.
Studio/Location: Not Forgotten locations, Zoom, community, or studio.
1. Acknowledgement of Risk
The Participant acknowledges that participation in programs, activities, or events organized by NFHCS—whether conducted at Not Forgotten locations, Zoom, community, or studio settings—comes with inherent risks. These may include but are not limited to illness, injury, accidents, property damage, and other hazards, whether known or unknown, foreseeable or unforeseeable.
2. Voluntary Participation and Assumption of Risk
The Participant voluntarily chooses to participate in NFHCS activities and accepts and assumes all risks related to such participation.
3. Release and Hold Harmless
To the fullest extent permitted by applicable law, the Participant RELEASES, WAIVES, DISCHARGES, COVENANTS NOT TO SUE, INDEMNIFIES AND HOLDS HARMLESS NFHCS from any and all claims, demands, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of or related to any injury, illness, accident, death, or property damage occurring during or in connection with participation in NFHCS activities or presence at NFHCS facilities, or through online/virtual participation, whether caused by the negligence of NFHCS or otherwise.
4. Scope of Agreement
This Agreement applies to all activities and services provided by NFHCS, including but not limited to in-person programs, online/virtual classes or events, off-site events, social gatherings, and any other participation connected with NFHCS.
5. Medical Treatment
In the event of injury or illness, the Participant gives consent for emergency medical treatment and agrees to be financially responsible for any associated costs.
6. Binding Effect
This Agreement shall be binding upon the Participant and the Participant’s heirs, legal representatives, executors, administrators, and assigns. If any portion of this Agreement is found to be unenforceable, the remainder shall continue in full force and effect.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware.
